ถ้าธนาคารเขียนข้อความลงลายมือชื่อบนเช็ค เช่นคำว่า “ใช้ได้” หรือ “ใช้เงินได้” หรือคำใด ๆ อันแสดงผลอย่างเดียวกัน ท่านว่าธนาคารต้องผูกพันในฐานเป็นลูกหนี้ชั้นต้นในอันจะต้องใช้เงินแก่ผู้ทรงตามเช็คนั้นถ้าผู้ทรงเช็คเป็นผู้จัดการให้ธนาคารลงข้อความรับรองดังว่านั้น ท่านว่าผู้สั่งจ่ายและผู้สลักหลังทั้งปวงเป็นอันหลุดพ้นจากความรับผิดตามเช็คนั้นถ้าธนาคารลงข้อความรับรองดังนั้น โดยคำขอร้องของผู้สั่งจ่าย ท่านว่าผู้สั่งจ่ายและปวงผู้สลักหลังก็หาหลุดพ้นไปไม่

English translation
If a bank writes on a cheque and signs words such as "good" or "payable", or any words to the like effect, the bank is bound as principal debtor to pay the cheque to the holder. Where the holder procures the bank to certify the cheque in that manner, the drawer and all endorsers are discharged from liability on it. Where the bank certifies the cheque at the request of the drawer, neither the drawer nor the endorsers are discharged.
