เช็คขีดคร่อมเฉพาะให้แก่ธนาคารกว่าธนาคารหนึ่งขึ้นไปเมื่อนำเบิกเอาแก่ธนาคารใด ท่านให้ธนาคารนั้นบอกปัดเสียอย่าใช้เงินให้ เว้นแต่ที่ขีดคร่อมให้แก่ธนาคารในฐานเป็นตัวแทนเรียกเก็บเงินธนาคารใดซึ่งเขานำเช็คเบิกขืนใช้เงินไปตามเช็คที่ขีดคร่อมอย่างว่ามานั้นก็ดี ใช้เงินตามเช็คอันเขาขีดคร่อมทั่วไปเป็นประการอื่นนอกจากใช้ให้แก่ธนาคารอันใดอันหนึ่งก็ดี ใช้เงินตามเช็คอันเขาขีดคร่อมเฉพาะเป็นประการอื่นนอกจากใช้ให้แก่ธนาคารซึ่งเขาเจาะจงขีดคร่อมให้โดยเฉพาะ หรือแก่ธนาคารตัวแทนเรียกเก็บเงินของธนาคารนั้นก็ดี ท่านว่าธนาคารซึ่งใช้เงินไปดังกล่าวนี้จะต้องรับผิดต่อผู้เป็นเจ้าของอันแท้จริงแห่งเช็คนั้น ในการที่เขาจะต้องเสียหายอย่างใด ๆ เพราะการที่ตนใช้เงินไปตามเช็คดังนั้นแต่หากเช็คใดเขานำยื่นเพื่อให้ใช้เงิน และเมื่อยื่นไม่ปรากฏว่าเป็นเช็คขีดคร่อมก็ดี หรือไม่ปรากฏว่ามีรอยขีดคร่อมอันได้ลบล้างหรือแก้ไขเปลี่ยนแปลงเพิ่มเติมเป็นประการอื่นนอกจากที่อนุญาตไว้โดยกฎหมายก็ดี เช็คเช่นนี้ถ้าธนาคารใดใช้เงินไปโดยสุจริตและปราศจากประมาทเลินเล่อ ท่านว่าธนาคารนั้นไม่ต้องรับผิดหรือต้องมีหน้าที่รับใช้เงินอย่างใด ๆ

English translation

Where a cheque is crossed specially to more than one bank, the bank on which it is drawn must refuse payment, unless the crossing is to a bank acting as collecting agent. Where a bank on which a cheque is drawn pays a cheque so crossed, or pays a cheque crossed generally otherwise than to a bank, or pays a cheque crossed specially otherwise than to the bank to which it is crossed or to that bank's collecting agent, the bank so paying is liable to the true owner of the cheque for any loss he suffers by reason of that payment. However, where a cheque is presented for payment and does not at the time of presentment appear to be crossed, or to have had a crossing obliterated or altered or added to otherwise than as authorised by law, a bank paying it in good faith and without negligence is not liable.
