ธนาคารใดซึ่งเขานำเช็คขีดคร่อมเบิกเงิน ใช้เงินไปตามเช็คนั้นโดยสุจริตและปราศจากประมาทเลินเล่อ กล่าวคือว่าถ้าเป็นเช็คขีดคร่อมทั่วไปก็ใช้เงินให้แก่ธนาคารอันใดอันหนึ่ง ถ้าเป็นเช็คขีดคร่อมเฉพาะก็ใช้ให้แก่ธนาคารซึ่งเขาเจาะจงขีดคร่อมให้โดยเฉพาะ หรือใช้ให้แก่ธนาคารตัวแทนเรียกเก็บเงินของธนาคารนั้นไซร้ ท่านว่าธนาคารซึ่งใช้เงินไปตามเช็คนั้นฝ่ายหนึ่ง กับถ้าเช็คตกไปถึงมือผู้รับเงินแล้ว ผู้สั่งจ่ายอีกฝ่ายหนึ่งต่างมีสิทธิเป็นอย่างเดียวกัน และเข้าอยู่ในฐานะอันเดียวกันเสมือนดังว่าเช็คนั้นได้ใช้เงินให้แก่ผู้เป็นเจ้าของอันแท้จริงแล้ว
