Section 222/6 — Class action officer qualifications

ผู้ที่จะได้รับแต่งตั้งเป็นเจ้าพนักงานคดีแบบกลุ่ม ต้องมีคุณสมบัติอย่างหนึ่งอย่างใด ดังต่อไปนี้
(๑) สำเร็จการศึกษาระดับปริญญาโททางกฎหมายหรือปริญญาเอกทางกฎหมาย
(๒) สำเร็จการศึกษาระดับปริญญาตรีทางกฎหมาย เป็นสามัญสมาชิกแห่งเนติบัณฑิตยสภา และได้ประกอบวิชาชีพทางกฎหมายตามที่คณะกรรมการข้าราชการศาลยุติธรรมตามกฎหมายว่าด้วยระเบียบบริหารราชการศาลยุติธรรมกำหนดเป็นเวลาไม่น้อยกว่าหนึ่งปี
(๓) สำเร็จการศึกษาระดับปริญญาตรีทางกฎหมายและปริญญาในสาขาวิชาอื่นที่คณะกรรมการข้าราชการศาลยุติธรรมตามกฎหมายว่าด้วยระเบียบบริหารราชการศาลยุติธรรมกำหนดซึ่งไม่ต่ำกว่าปริญญาตรี และได้ประกอบวิชาชีพตามที่คณะกรรมการข้าราชการศาลยุติธรรมตามกฎหมายว่าด้วยระเบียบบริหารราชการศาลยุติธรรมกำหนดเป็นเวลาไม่น้อยกว่าสี่ปี
ให้เลขาธิการสำนักงานศาลยุติธรรมมีอำนาจพิจารณาแต่งตั้งบุคคลซึ่งมีคุณสมบัติตามวรรคหนึ่ง เป็นเจ้าพนักงานคดีแบบกลุ่ม ทั้งนี้ ตามระเบียบที่คณะกรรมการข้าราชการศาลยุติธรรมตามกฎหมายว่าด้วยระเบียบบริหารราชการศาลยุติธรรมกำหนด

English translation

A person to be appointed as a class action officer must have one of the following qualifications:
(1) having completed a master's degree in law or a doctoral degree in law;
(2) having completed a bachelor's degree in law, being an ordinary member of the Thai Bar Association, and having practiced in a legal profession as prescribed by the Judicial Civil Service Commission under the law on the administration of the courts of justice for a period of not less than one year;
(3) having completed a bachelor's degree in law and a degree in another field as prescribed by the Judicial Civil Service Commission under the law on the administration of the courts of justice, being not lower than a bachelor's degree, and having practiced in a profession as prescribed by that Commission for a period of not less than four years.
The Secretary-General of the Office of the Courts of Justice shall have the power to consider and appoint a person who has the qualifications under paragraph one as a class action officer, in accordance with the regulations prescribed by the Judicial Civil Service Commission under the law on the administration of the courts of justice.
