ในกรณีที่ทรัพย์สินหรือสิทธิเรียกร้องที่เจ้าหนี้ตามคำพิพากษาอ้างว่าเป็นของลูกหนี้ตามคำพิพากษามีชื่อบุคคลอื่นเป็นเจ้าของในทะเบียนหรือปรากฏตามหลักฐานอย่างอื่นว่าเป็นของบุคคลอื่น หากเจ้าพนักงานบังคับคดีสงสัยว่าทรัพย์สินหรือสิทธิเรียกร้องนั้นไม่ใช่เป็นของลูกหนี้ตามคำพิพากษาและไม่ยอมทำการยึดหรืออายัด ถ้าเจ้าหนี้ตามคำพิพากษายืนยันให้ยึดหรืออายัด เจ้าพนักงานบังคับคดีจะทำการยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องนั้น หรือจะสั่งงดการยึดหรือการอายัดก็ได้ ในกรณีที่สั่งงด ให้เจ้าพนักงานบังคับคดีมีคำสั่งห้ามการโอน ขาย ยักย้าย จำหน่าย ทำลาย ทำให้เสื่อมค่า หรือเปลี่ยนแปลงซึ่งสิทธิในทรัพย์สินหรือสิทธิเรียกร้องนั้นไว้ก่อน
คำสั่งห้ามของเจ้าพนักงานบังคับคดีตามวรรคหนึ่งให้มีผลใช้บังคับได้ทันที และให้เจ้าพนักงานบังคับคดีแจ้งคำสั่งห้ามให้ลูกหนี้ตามคำพิพากษา และบุคคลผู้มีชื่อเป็นเจ้าของทรัพย์สินหรือสิทธิเรียกร้องตามที่ปรากฏในทะเบียนหรือหลักฐานอย่างอื่นทราบโดยเร็ว ในกรณีที่ทรัพย์สินดังกล่าวเป็นทรัพย์สินที่จะต้องจดทะเบียนหรือได้จดทะเบียนไว้ตามกฎหมาย ให้เจ้าพนักงานบังคับคดีแจ้งคำสั่งห้ามดังกล่าวให้นายทะเบียนหรือพนักงานเจ้าหน้าที่ผู้มีอำนาจหน้าที่จดทะเบียนตามกฎหมายว่าด้วยการนั้นทราบด้วย ถ้าได้มีการจดทะเบียนไว้แล้ว ให้นายทะเบียนหรือพนักงานเจ้าหน้าที่บันทึกคำสั่งของเจ้าพนักงานบังคับคดีไว้ในทะเบียน ทั้งนี้ ให้นำบทบัญญัติมาตรา ๓๑๕

เจ้าหนี้ตามคำพิพากษาอาจยื่นคำร้องต่อศาลภายในสิบห้าวันนับแต่วันที่เจ้าพนักงานบังคับคดีมีคำสั่งงดการยึดหรือการอายัดตามวรรคหนึ่ง เพื่อขอให้ศาลสั่งให้เจ้าพนักงานบังคับคดีทำการยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องนั้น ในกรณีเช่นนี้ ให้ศาลส่งสำเนาคำร้องแก่เจ้าพนักงานบังคับคดีและบุคคลผู้มีชื่อเป็นเจ้าของทรัพย์สินหรือสิทธิเรียกร้องตามที่ปรากฏในทะเบียนหรือหลักฐานอย่างอื่นทราบ และบุคคลดังกล่าวอาจคัดค้านว่าทรัพย์สินหรือสิทธิเรียกร้องนั้นไม่ใช่ของลูกหนี้ตามคำพิพากษาได้ โดยยื่นคำคัดค้านต่อศาลภายในสิบห้าวันนับแต่วันที่รับสำเนาคำร้อง และให้นำบทบัญญัติมาตรา ๓๒๓ หรือมาตรา ๓๒๕ แล้วแต่กรณี มาใช้บังคับโดยอนุโลม โดยหากศาลมีคำสั่งให้ยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องแล้ว บุคคลดังกล่าวที่ได้ยื่นคำคัดค้านตามวรรคนี้จะใช้สิทธิตามมาตรา ๓๒๓ หรือมาตรา ๓๒๕ แล้วแต่กรณี อีกหาได้ไม่
ในกรณีที่เจ้าหนี้ตามคำพิพากษามิได้ยื่นคำร้องภายในกำหนดเวลาตามวรรคสามหรือศาลมีคำสั่งยกคำร้องดังกล่าว หรือในกรณีที่ศาลมีคำสั่งอนุญาตตามคำร้องในวรรคสาม แต่เจ้าหนี้ตามคำพิพากษาไม่ดำเนินการบังคับคดีแก่ทรัพย์สินหรือสิทธิเรียกร้องดังกล่าวภายในสิบห้าวันนับแต่วันที่ศาลมีคำสั่ง ให้คำสั่งห้ามตามวรรคหนึ่งเป็นอันยกเลิกไป และให้เจ้าพนักงานบังคับคดีแจ้งการยกเลิกคำสั่งห้ามดังกล่าวให้บุคคลตามวรรคสองทราบด้วย
English translation
Where property or a claim that the judgment creditor asserts belongs to the judgment debtor is registered in the name of another person as owner, or appears from other evidence to belong to another person, and the executing officer doubts that the property or claim belongs to the judgment debtor and refuses to seize or attach it, then, if the judgment creditor insists on the seizure or attachment, the executing officer may seize that property or attach that claim, or may order a stay of the seizure or attachment. Where he orders a stay, the executing officer shall issue an order prohibiting the transfer, sale, removal, disposal, destruction, impairment of value, or alteration of the rights in that property or claim in the meantime.
The prohibition order of the executing officer under paragraph one shall take effect immediately, and the executing officer shall promptly notify the judgment debtor and the person named as owner of the property or claim in the register or in other evidence of the prohibition order. Where such property must be or has been registered under the law, the executing officer shall also notify the registrar or the competent official having the duty of registration under the law concerned, and if it has already been registered, the registrar or the official shall record the executing officer's order in the register. The provisions of Section 315 (1) and Section 320 (1) shall apply mutatis mutandis.
The judgment creditor may file a motion with the court within fifteen days from the day on which the executing officer orders a stay of the seizure or attachment under paragraph one, to request the court to order the executing officer to seize that property or attach that claim. In such case, the court shall serve a copy of the motion on the executing officer and on the person named as owner of the property or claim in the register or in other evidence, and that person may object that the property or claim does not belong to the judgment debtor by filing an objection with the court within fifteen days from the day of receiving the copy of the motion; and the provisions of Section 323 or Section 325, as the case may be, shall apply mutatis mutandis. If the court orders the seizure of the property or the attachment of the claim, the person who has filed an objection under this paragraph may not further exercise the right under Section 323 or Section 325, as the case may be.
Where the judgment creditor has not filed a motion within the period under paragraph three, or the court dismisses the motion, or the court grants the motion under paragraph three but the judgment creditor does not proceed with the execution against that property or claim within fifteen days from the day of the court's order, the prohibition order under paragraph one shall lapse, and the executing officer shall notify the persons under paragraph two of the lapse of that prohibition order.

Section 298 resolves the recurring problem of assets the creditor believes are the debtor's but that stand in another person's name. It balances the creditor's insistence against the officer's doubt: the officer may seize on the creditor's insistence, or stay and freeze the asset, triggering a fifteen-day window for the creditor to move the court and a matching window for the registered owner to object under Section 323 or Section 325. Section 298 paragraph one governs the case where property the creditor claims is the debtor's is registered in another person's name and the executing officer doubts ownership and declines to seize unless the creditor insists; the provision frames who may then contest ownership.
The creditor asked to seize a hotel it claimed belonged to the first defendant, though registered to another. The Court examined, under Section 298 paragraph one, whether the judgment debtor itself could file an objection that the hotel was not the debtor's property, quoting the paragraph in full as the governing rule.

Frequently asked questions
Can I seize an asset the debtor hid under someone else's name?
Under Section 298 you can insist the executing officer seize it. If the officer doubts ownership and stays the seizure, you have fifteen days to petition the court to order the seizure or attachment.
Can the registered owner object to the seizure?
Yes. Under Section 298 paragraph three, the person named as owner may object within fifteen days of receiving the creditor's motion that the property does not belong to the debtor, applying Section 323 or Section 325.
What if the creditor misses the fifteen-day deadline?
