traduction anglaise

Where property or a claim that the judgment creditor asserts belongs to the judgment debtor is registered in the name of another person as owner, or appears from other evidence to belong to another person, and the executing officer doubts that the property or claim belongs to the judgment debtor and refuses to seize or attach it, then, if the judgment creditor insists on the seizure or attachment, the executing officer may seize that property or attach that claim, or may order a stay of the seizure or attachment. Where he orders a stay, the executing officer shall issue an order prohibiting the transfer, sale, removal, disposal, destruction, impairment of value, or alteration of the rights in that property or claim in the meantime.
The prohibition order of the executing officer under paragraph one shall take effect immediately, and the executing officer shall promptly notify the judgment debtor and the person named as owner of the property or claim in the register or in other evidence of the prohibition order. Where such property must be or has been registered under the law, the executing officer shall also notify the registrar or the competent official having the duty of registration under the law concerned, and if it has already been registered, the registrar or the official shall record the executing officer's order in the register. The provisions of Section 315 (1) and Section 320 (1) shall apply mutatis mutandis.
The judgment creditor may file a motion with the court within fifteen days from the day on which the executing officer orders a stay of the seizure or attachment under paragraph one, to request the court to order the executing officer to seize that property or attach that claim. In such case, the court shall serve a copy of the motion on the executing officer and on the person named as owner of the property or claim in the register or in other evidence, and that person may object that the property or claim does not belong to the judgment debtor by filing an objection with the court within fifteen days from the day of receiving the copy of the motion; and the provisions of Section 323 or Section 325, as the case may be, shall apply mutatis mutandis. If the court orders the seizure of the property or the attachment of the claim, the person who has filed an objection under this paragraph may not further exercise the right under Section 323 or Section 325, as the case may be.
Where the judgment creditor has not filed a motion within the period under paragraph three, or the court dismisses the motion, or the court grants the motion under paragraph three but the judgment creditor does not proceed with the execution against that property or claim within fifteen days from the day of the court's order, the prohibition order under paragraph one shall lapse, and the executing officer shall notify the persons under paragraph two of the lapse of that prohibition order.

Annotation de l'entreprise

Section 298 resolves the recurring problem of assets the creditor believes are the debtor's but that stand in another person's name. It balances the creditor's insistence against the officer's doubt: the officer may seize on the creditor's insistence, or stay and freeze the asset, triggering a fifteen-day window for the creditor to move the court and a matching window for the registered owner to object under Section 323 or Section 325. Time limits at every stage keep third-party assets from being frozen indefinitely, and a lapse mechanism clears the freeze if the creditor does not follow through. It works with Section 296 and Section 297 and reflects the 2017 renumbering; decisions citing the old Section 298 concerned arrest procedures for a defaulting debtor.

Pourquoi cela est important en pratique

This is the key provision when a debtor hides assets under a relative's or nominee's name: a creditor who is sure the property is really the debtor's can insist the officer seize it, and if the officer hesitates, take the fight to court within fifteen days. Missing that fifteen-day window lets the freeze lapse and the asset walk, so timing is critical. Tracing and challenging nominee ownership is technical work; a Avocat spécialisé dans le recouvrement de créances en Thaïlande can build and file the motion in time.

Décisions de la Cour suprême interprétant cette section

  1. Supreme Court Judgment No. 5053/2565 (2022)

Section 298 paragraph one governs the case where property the creditor claims is the debtor's is registered in another person's name and the executing officer doubts ownership and declines to seize unless the creditor insists; the provision frames who may then contest ownership.

The creditor asked to seize a hotel it claimed belonged to the first defendant, though registered to another. The Court examined, under Section 298 paragraph one, whether the judgment debtor itself could file an objection that the hotel was not the debtor's property, quoting the paragraph in full as the governing rule.

  2. Supreme Court Judgment No. 1188/2564 (2021)

Where the executing officer stays a seizure of property the creditor claims is the debtor's but that is registered in another's name, the creditor's remedy is to petition the court under Section 298 paragraph three to order the seizure, not to proceed by way of attachment.

The creditor sought to seize property it claimed belonged to the debtor but registered to another, and the officer stayed the seizure. The Court held this was a Section 298 paragraph three situation, where the creditor petitions the court to order the seizure, and not a case to be handled by an attachment order as the Court of Appeal had reasoned. Being a public-order point, it was raised on the Court's own motion.

Foire aux questions

Can I seize an asset the debtor hid under someone else's name?

Under Section 298 you can insist the executing officer seize it. If the officer doubts ownership and stays the seizure, you have fifteen days to petition the court to order the seizure or attachment.

Can the registered owner object to the seizure?

Yes. Under Section 298 paragraph three, the person named as owner may object within fifteen days of receiving the creditor's motion that the property does not belong to the debtor, applying Section 323 or Section 325.

What if the creditor misses the fifteen-day deadline?

The freeze lapses. Under paragraph four, if the creditor does not file in time, the court dismisses the motion, or the creditor fails to proceed within fifteen days of a granting order, the prohibition order is cancelled.
