Section 302: Income exempt from execution

ภายใต้บังคับบทบัญญัติแห่งกฎหมายอื่น เงินหรือสิทธิเรียกร้องเป็นเงินของลูกหนี้ตามคำพิพากษาต่อไปนี้ ไม่อยู่ในความรับผิดแห่งการบังคับคดี
(๑) เบี้ยเลี้ยงชีพซึ่งกฎหมายกำหนดไว้ ส่วนเงินรายได้เป็นคราว ๆ ซึ่งบุคคลภายนอกได้ยกให้เพื่อเลี้ยงชีพนั้น ให้มีจำนวนไม่เกินเดือนละสองหมื่นบาทหรือตามจำนวนที่เจ้าพนักงานบังคับคดีเห็นสมควร
(๒) เงินเดือน ค่าจ้าง บำนาญ บำเหน็จ เบี้ยหวัด หรือรายได้อื่นในลักษณะเดียวกันของข้าราชการ เจ้าหน้าที่ หรือลูกจ้างในหน่วยราชการ และเงินสงเคราะห์ บำนาญ หรือบำเหน็จที่หน่วยราชการได้จ่ายให้แก่คู่สมรสหรือญาติที่ยังมีชีวิตของบุคคลเหล่านั้น
(๓) เงินเดือน ค่าจ้าง บำนาญ ค่าชดใช้ เงินสงเคราะห์ หรือรายได้อื่นในลักษณะเดียวกันของพนักงาน ลูกจ้าง หรือคนงาน นอกจากที่กล่าวไว้ใน
(๒) ที่นายจ้างหรือบุคคลอื่นใดได้จ่ายให้แก่บุคคลเหล่านั้น หรือคู่สมรส หรือญาติที่ยังมีชีวิตของบุคคลเหล่านั้น เป็นจำนวนรวมกันไม่เกินเดือนละสองหมื่นบาทหรือตามจำนวนที่เจ้าพนักงานบังคับคดีเห็นสมควร
(๔) บำเหน็จหรือค่าชดเชยหรือรายได้อื่นในลักษณะเดียวกันของบุคคลตาม
(๓) เป็นจำนวนไม่เกินสามแสนบาทหรือตามจำนวนที่เจ้าพนักงานบังคับคดีเห็นสมควร
(๕) เงินฌาปนกิจสงเคราะห์ที่ลูกหนี้ตามคำพิพากษาได้รับอันเนื่องมาแต่ความตายของบุคคลอื่นเป็นจำนวนตามที่จำเป็นในการดำเนินการฌาปนกิจศพตามฐานะของผู้ตายที่เจ้าพนักงานบังคับคดีเห็นสมควร
ในกรณีที่เจ้าพนักงานบังคับคดีเป็นผู้กำหนดจำนวนเงินตาม
(๑)
(๓) และ
(๔) ให้เจ้าพนักงานบังคับคดีคำนึงถึงฐานะในทางครอบครัวของลูกหนี้ตามคำพิพากษาและจำนวนบุพการีและผู้สืบสันดานซึ่งอยู่ในความอุปการะของลูกหนี้ตามคำพิพากษาด้วย และสำหรับในกรณีตาม
(๑) และ
(๓) ให้เจ้าพนักงานบังคับคดีกำหนดให้ไม่น้อยกว่าอัตราเงินเดือนขั้นต่ำสุดของข้าราชการพลเรือนในขณะนั้นและไม่เกินอัตราเงินเดือนขั้นสูงสุดของข้าราชการพลเรือนในขณะนั้น
ถ้าเจ้าหนี้ตามคำพิพากษา ลูกหนี้ตามคำพิพากษา หรือบุคคลภายนอกผู้มีส่วนได้เสียในการบังคับคดีไม่เห็นด้วยกับจำนวนเงินที่เจ้าพนักงานบังคับคดีกำหนด บุคคลดังกล่าวอาจยื่นคำร้องต่อศาลภายในสิบห้าวันนับแต่วันที่ได้ทราบถึงการกำหนดจำนวนเงินเช่นว่านั้น เพื่อขอให้ศาลกำหนดจำนวนเงินใหม่ได้
ในกรณีที่พฤติการณ์แห่งการดำรงชีพของลูกหนี้ตามคำพิพากษาได้เปลี่ยนแปลงไป บุคคลตามวรรคสามจะยื่นคำร้องให้ศาลหรือเจ้าพนักงานบังคับคดี แล้วแต่กรณี กำหนดจำนวนเงินตาม
(๑) และ

English translation

Subject to the provisions of other laws, the following money or claims for money of the judgment debtor are not subject to execution:
(1) subsistence allowances fixed by law; and periodic income given by a third person for the debtor's subsistence, in an amount not exceeding twenty thousand baht per month or such amount as the executing officer sees fit;
(2) the salary, wages, pension, gratuity, retainer, or other income of a like nature of a government official, officer, or employee of a government agency, and the relief payment, pension, or gratuity paid by a government agency to the spouse or surviving relatives of such persons;
(3) the salary, wages, pension, compensation, relief payment, or other income of a like nature of an employee or worker, other than those mentioned in (2), paid by an employer or any other person to those persons, or to their spouse or surviving relatives, in a combined amount not exceeding twenty thousand baht per month or such amount as the executing officer sees fit;
(4) the gratuity, severance pay, or other income of a like nature of a person under (3), in an amount not exceeding three hundred thousand baht or such amount as the executing officer sees fit;
(5) cremation relief money received by the judgment debtor by reason of the death of another person, in the amount necessary to conduct the funeral according to the station of the deceased as the executing officer sees fit.
Where the executing officer fixes the amount under (1), (3), and (4), the officer shall have regard to the family circumstances of the judgment debtor and the number of ascendants and descendants under the debtor's support; and for cases under (1) and (3) the officer shall fix an amount not lower than the lowest civil service salary rate then in force and not higher than the highest civil service salary rate then in force.
If the judgment creditor, the judgment debtor, or a third person having an interest in the execution disagrees with the amount fixed by the executing officer, such person may file a motion with the court within fifteen days from learning of the fixing of that amount, seeking the court to fix a new amount.
Where the circumstances of the judgment debtor's livelihood have changed, a person under paragraph three may file a motion for the court or the executing officer, as the case may be, to fix a new amount under (1) and (3).

This is the income-exemption rule in Part 2, protecting the wages, pensions, and welfare payments a judgment debtor needs to live. The private-sector wage exemption in (3) is capped at twenty thousand baht per month, severance in (4) at three hundred thousand baht, while (2) fully protects government pay and pensions. The current thresholds reflect the amendment to the Code (No. 30) B.E. 2560. The executing officer must weigh the debtor's family circumstances and dependents, and any disagreement over the fixed amount goes to the court within fifteen days.

Why this matters in practice

If your salary or bank account is being attached, check the exempt ceilings first: private wages are protected up to about 20,000 baht per month, and severance up to about 300,000 baht. Government pensions and gratuities, and retirement-fund benefits of an equivalent kind, are protected in full. Where an attachment leaves you too little to live on, file with the court within fifteen days to have the amount reset.

Supreme Court decisions interpreting this section

  1. Supreme Court Judgment No. 4468/2566 (2023)

    An attachment notice sent to an employer can only reach a right that has already arisen. Where the officer writes to the employer to attach salary, wages, bonus, occasional remuneration and termination payments while the debtor is still employed, the notice bites only on the monthly salary; the debtor has no right yet to severance pay, pay in lieu of advance notice or special assistance, because there has been no termination. The exemptions are also distinct. Section 302(3) is what covers the ongoing monthly salary already validly attached before termination, while severance pay, pay in lieu of advance notice and special assistance received on termination are exempt under section 302(4), which caps the exemption at 300,000 baht.

    The execution officer had written to the first defendant's employer on 24 February 2558 to attach salary, wages, bonus, occasional remuneration and termination payments. At that date the defendant was still employed, so the only right in existence was to the monthly salary; the rights to severance pay, pay in lieu of advance notice and special assistance had not yet arisen because there had been no termination. When those sums were later attached and the defendant moved to have the attachment revoked, the Supreme Court held that the earlier notice could not reach them, and that the exemption for those termination payments is the one in section 302(4), capped at 300,000 baht, rather than section 302(3), which is directed to the ongoing monthly salary that had already been validly attached.

  2. Supreme Court Judgment No. 1473/2563 (2020)

    Contributions, compensation and initial money under section 5 paragraph two of the Government Pension Fund Act B.E. 2539, and the returns on them, are income of a like nature to a civil servant's pension and gratuity and are not subject to execution under Section 302 (2). But once the member has died and the bank has already remitted the money to the court in the course of execution, that money becomes part of the estate under Civil and Commercial Code section 1600 and loses that character, so the attachment need not be revoked.

    A surety on a bail bond was fined 400,000 baht and the trial court attached her bank account, which held 639,591.90 baht of Government Pension Fund money together with her salary. The Supreme Court agreed the fund money was exempt under Section 302 (2), so attaching the account did not comply with the Code within Section 27 paragraph one. It nevertheless allowed the objector's appeal in part: the surety had died on 8 November 2560 and the bank had already remitted the 400,000 baht to the court, which made that sum part of her estate under Civil and Commercial Code section 1600 and took it outside Section 302 (2). Since she had wanted the fine paid out of that account from the start, there was no need to revoke the attachment and execution was to proceed as the trial court had ordered.

  3. Supreme Court Judgment No. 1498/2566 (2023)

    Section 302 governs execution against a judgment debtor's money. It cannot be applied even by analogy, as the nearest applicable law under Civil and Commercial Code section 4 paragraph two, to deductions an employer makes from wages with the employee's written consent to pay a savings-cooperative debt. Those deductions are governed by clause 31 of the State Enterprise Labour Relations Committee's announcement on minimum conditions of employment in state enterprises, which fixes no minimum sum that must be left to the employee once written consent has been given in advance.

    A state-enterprise employee who had signed a written consent to deductions for a savings-cooperative debt argued that at least twenty thousand baht of wages had to be left each month, by analogy with Section 302 paragraph one (3). The Supreme Court rejected that: Section 302 deals with execution against a judgment debtor and cannot be borrowed as the nearest applicable law under Civil and Commercial Code section 4 paragraph two, so neither the twenty-thousand-baht figure nor a residue fixed by the court could be imposed. The deductions were governed by clause 31 of the announcement on minimum conditions of employment in state enterprises and by the consent the employee had given.
