Section 7 — Special venue rules overriding the general ones

บทบัญญัติในมาตรา ๔ มาตรา ๔ ทวิ มาตรา ๔ ตรี มาตรา ๔ จัตวา มาตรา ๔ เบญจ มาตรา ๔ ฉ มาตรา ๕ มาตรา ๖ และมาตรา ๖/๑ ต้องอยู่ภายใต้บังคับแห่งบทบัญญัติดังต่อไปนี้
(๑) คำฟ้องหรือคำร้องขอที่เสนอภายหลังเกี่ยวเนื่องกับคดีที่ค้างพิจารณาอยู่ในศาลใด ให้เสนอต่อศาลนั้น
(๒) คำฟ้องหรือคำร้องขอที่เสนอเกี่ยวเนื่องกับการบังคับคดีตามคำพิพากษาหรือคำสั่งของศาล ซึ่งคำฟ้องหรือคำร้องขอนั้นจำต้องมีคำวินิจฉัยของศาลก่อนที่การบังคับคดีจะได้ดำเนินไปได้โดยครบถ้วนและถูกต้องนั้น ให้เสนอต่อศาลที่กำหนดไว้ในมาตรา ๒๗๑
(๓) คำร้องตามมาตรา ๑๐๑ ถ้าได้เสนอคำฟ้องหรือคำร้องขอต่อศาลใดแล้ว ให้เสนอต่อศาลนั้น ในกรณีที่ยังไม่ได้เสนอคำฟ้องหรือคำร้องขอต่อศาลใด ถ้าพยานหลักฐานซึ่งจะเรียกมาสืบหรือบุคคลหรือทรัพย์หรือสถานที่ที่จะต้องตรวจอยู่ในเขตศาลใด ให้เสนอต่อศาลนั้น
(๔) คำร้องที่เสนอให้ศาลถอนคืนหรือเปลี่ยนแปลงคำสั่งหรือการอนุญาตที่ศาลได้ให้ไว้ก็ดี คำร้องที่เสนอให้ศาลถอดถอนบุคคลใดจากฐานะที่ศาลได้แต่งตั้งไว้ก็ดี คำร้องที่เสนอให้ศาลมีคำสั่งใดที่เกี่ยวกับการถอนคืนหรือเปลี่ยนแปลงคำสั่งหรือการอนุญาตหรือที่เกี่ยวกับการแต่งตั้งเช่นว่านั้นก็ดี คำร้องขอหรือคำร้องอื่นใดที่เสนอเกี่ยวเนื่องกับคดีที่ศาลได้มีคำพิพากษาหรือคำสั่งไปแล้วก็ดี ให้เสนอต่อศาลในคดีที่ได้มีคำสั่ง การอนุญาต การแต่งตั้ง หรือคำพิพากษานั้น

The provisions of Section 4, Section 4 bis, Section 4 ter, Section 4 quater, Section 4 quinque, Section 4 sex, Section 5, Section 6, and Section 6/1 are subject to the following provisions:
(1) a plaint or petition submitted later that is connected with a case pending in a court shall be submitted to that court;
(2) a plaint or petition submitted in connection with the enforcement of a judgment or order of the court, where that plaint or petition must be decided by the court before enforcement can proceed completely and correctly, shall be submitted to the court specified in Section 271;
(3) a motion under Section 101: if a plaint or petition has already been submitted to a court, it shall be submitted to that court; where no plaint or petition has yet been submitted to any court, if the evidence to be taken, or the person, property, or place to be examined, is within the jurisdiction of a court, it shall be submitted to that court;
(4) a motion asking the court to withdraw or change an order or permission it has given; a motion asking the court to remove any person from a position to which the court appointed them; a motion asking the court to make any order relating to such withdrawal, change, or appointment; and a petition or any other motion submitted in connection with a case in which the court has already given a judgment or order, shall be submitted to the court in the case in which that order, permission, appointment, or judgment was made.

Section 7 is an express override: it makes the general venue rules in Sections 4 to 6/1 yield to four situations where continuity requires filing in a particular court. Subsection (1) keeps connected later filings with the pending case; subsection (2) channels enforcement related filings that must be decided before execution can proceed to the court under Section 271; subsection (3) directs evidence preservation motions under Section 101; and subsection (4) sends motions to withdraw, change, or make orders about earlier orders, appointments, or judgments back to the court that made them. The unifying idea is that a court which is handling or has decided a matter is the proper forum for follow on steps connected to it. This is why challenges to an execution auction, for example, belong in the original execution court rather than a fresh suit.

Why this matters in practice

The common mistake this section prevents is filing a fresh lawsuit when the right route is a motion in the existing case, for example to challenge how an execution or auction was carried out. Getting this wrong can mean your new suit is dismissed and you lose time, so if your issue is connected to a case that is pending or already decided, the starting point is the court that has or had that case. Supreme Court decisions interpreting this section

  1. Supreme Court Judgment No. 2564/2567 (2024)

    A challenge to an execution auction is a filing connected with enforcement under Section 7(2), read with Section 271, and must be made in the original court that issued the writ of execution, not brought as a fresh suit.

    The plaintiff alleged an execution auction was unlawful and sought to set it aside by a new suit. The court held that under Section 7(2) with Section 271 the challenge had to be filed in the original court that issued the writ of execution, so the plaintiff had no power to bring a fresh case.

  2. Supreme Court Judgment No. 2774/2565 (2022)

    Section 7(2), read with Section 271, directs a filing connected with enforcement that the court must decide before execution can proceed to the court with authority over the execution, even where property is seized in another province on its behalf.

    Property was seized in Khon Kaen on behalf of the execution office in Kalasin. Quoting Section 7(2) and Section 271, the court confirmed that a filing connected with enforcement, which the court must decide before execution can proceed completely and correctly, goes to the court with authority over the execution.

  3. Supreme Court Judgment No. 3772/2565 (2022)

    A fresh claim that is not in fact connected with enforcing the earlier judgment need not be filed under Section 7(2) in the earlier court; the plaintiff may sue in the ordinary trial court.

    The court held the plaintiff's claim was neither a repeat suit under Section 148 nor a claim connected with enforcing the earlier judgment under Section 7(2), so the plaintiff could properly file it in the trial court rather than the original family court.
