Section 290 — Stay of execution for possible set-off

ลูกหนี้ตามคำพิพากษาอาจยื่นคำร้องต่อศาลให้งดการบังคับคดีไว้ โดยเหตุที่ตนได้ยื่นฟ้องเจ้าหนี้ตามคำพิพากษาเป็นคดีเรื่องอื่นในศาลเดียวกันนั้นไว้แล้ว ซึ่งศาลยังมิได้วินิจฉัยชี้ขาดและถ้าหากตนเป็นฝ่ายชนะจะไม่ต้องมีการยึด อายัด ขายทอดตลาด หรือจำหน่ายทรัพย์สินของลูกหนี้ตามคำพิพากษาโดยวิธีอื่น เพราะสามารถจะหักกลบลบหนี้กันได้
ถ้าศาลเห็นว่าข้ออ้างของลูกหนี้ตามคำพิพากษามีเหตุฟังได้ ศาลอาจมีคำสั่งให้งดการบังคับคดีไว้ คำสั่งนี้อาจอยู่ภายใต้บังคับเงื่อนไขหรือเงื่อนเวลาใด ๆ หรือไม่ก็ได้ และศาลจะมีคำสั่งให้ลูกหนี้ตามคำพิพากษาวางเงินหรือหาประกันต่อศาลตามจำนวนที่เห็นสมควรภายในระยะเวลาที่กำหนดเพื่อเป็นประกันการชำระหนี้ตามคำพิพากษาและค่าสินไหมทดแทนแก่เจ้าหนี้ตามคำพิพากษาสำหรับความเสียหายที่อาจได้รับเนื่องจากเหตุเนิ่นช้าในการบังคับคดีอันเกิดจากการยื่นคำร้องนั้นด้วยก็ได้

English translation

The judgment debtor may file a motion with the court to stay the execution on the ground that he has already brought an action against the judgment creditor as another case in the same court, which the court has not yet adjudicated, and that if he prevails there will be no need to seize, attach, sell by auction, or otherwise dispose of the judgment debtor's property, because the debts can be set off against each other.
If the court is of the opinion that the judgment debtor's contention has sustainable grounds, the court may order a stay of execution. This order may or may not be subject to any condition or time limit, and the court may also order the judgment debtor to deposit money or furnish security with the court in the amount it thinks fit within the period it sets, as security for payment of the judgment debt and of compensation to the judgment creditor for the damage that may be sustained through the delay in execution arising from the filing of the motion.
An order of the court under this Section shall be final.

Section 290 gives the judgment debtor a targeted route to stay execution where a cross-claim against the same creditor, pending in the same court, could extinguish the judgment debt by set-off if the debtor wins. The court has discretion to grant the stay on conditions and to protect the creditor by requiring a deposit or security against both the debt and any delay damage. The finality clause bars appeal of the stay decision. This is the current numbering after the 2017 reform: the same substance was formerly found under the old Section 293, and older decisions numbered 290 dealt with a different subject, the rateable distribution of proceeds among creditors.

This is a practical shield for a debtor who genuinely holds a counter-claim: rather than let the creditor collect now and chase a refund later, the debtor can freeze enforcement until the set-off case is decided. Can a judgment debtor stop execution while suing the creditor?

Yes, in a specific case. Under Section 290, if the debtor has a pending action against the same creditor in the same court and winning it would cancel the debt by set-off, the debtor may move for a stay of execution.

Can the debtor appeal a decision on a set-off stay?

No. Section 290 states that the court's order under this section is final, so there is no appeal against the grant or refusal of the stay.
