Section 287 — Who counts as an interested person

บุคคลผู้มีส่วนได้เสียในการบังคับคดี ได้แก่
(๑) เจ้าหนี้ตามคำพิพากษา ลูกหนี้ตามคำพิพากษา และในกรณีที่มีการอายัดสิทธิเรียกร้อง ให้รวมถึงลูกหนี้แห่งสิทธิเรียกร้อง ผู้ทรงสิทธิเรียกร้อง หรือผู้รับโอนสิทธิเรียกร้องนั้นด้วย
(๒) บุคคลผู้มีทรัพยสิทธิหรือได้จดทะเบียนสิทธิของตนเกี่ยวกับทรัพย์สินที่ถูกบังคับคดี
(๓) บุคคลซึ่งได้ยื่นคำร้องขอตามมาตรา ๓๒๓ มาตรา ๓๒๔ มาตรา ๓๒๖ และมาตรา ๓๒๙ เกี่ยวกับทรัพย์สินหรือสิทธิเรียกร้องที่ถูกบังคับคดี

The persons having an interest in the execution are:
(1) the judgment creditor, the judgment debtor, and, where a claim has been attached, also the debtor of the claim, the holder of the claim, or the transferee of that claim;
(2) a person who has a real right, or who has registered a right of his own, concerning the property under execution;
(3) a person who has filed a petition under Section 323, Section 324, Section 326, or Section 329 concerning the property or claim under execution;
(4) a person who is a co-owner, or a person having a preferential right, a right of retention, or another right under Section 322, concerning the property or claim under execution;
(5) any other person who must suffer damage by reason of the conduct of that execution.

Section 287 opens Part 7 by defining the class of interested persons in an execution, a definition that governs who may exercise the participation and objection rights granted elsewhere, notably in Section 288. Its five categories run from the immediate parties, through those with proprietary, registered, or security interests in the property or claim, to a residual catch-all for anyone who will suffer damage. This is a status-defining provision rather than an operative remedy. It stems from the 2017 restructuring of the execution provisions; older decisions numbered 287 concerned the protection of a mortgagee's or pledgee's preferential rights against execution, a topic now handled in the sections on distribution and preferential claims.

Whether you fall inside one of these five categories decides whether you can take part in an execution, object, or claim a share of proceeds, so identifying your status early is essential, for example if you co-own seized land or hold a mortgage over it.
