Firm annotation

Section 83 sexies fixes the delayed effective dates for service made within the Kingdom on a foreign-based party, mirroring the structure of Section 83 quinquies for service abroad but with shorter periods. Service of the initiating documents on the defendant or a local agent under Section 83 bis takes effect after thirty days; later documents served under Section 83 ter after fifteen days; and posting a notice at the court under Section 83 ter after thirty days. By expressly excluding Section 79, the section makes clear that the general rule on substituted service by posting does not override these tailored periods.

Why this matters in practice

If a foreign party is served within Thailand, these shorter periods, thirty or fifteen days, control when the response clock starts, so they are quicker than service abroad under Section 83 bis and Section 83 quinquies. This is one practical reason plaintiffs try to establish a valid local point of service. If you are a foreign party served here, note the effective date carefully so you do not lose the chance to respond. A online consultation with a Thai lawyer can confirm your response deadline.

Frequently asked questions

When does service on a foreign party within Thailand take effect?

Under Section 83 sexies, service of the summons and plaint takes effect after thirty days, later documents after fifteen days, and posting a notice at the court after thirty days.

Is local service on a foreign party faster than service abroad?

Yes. The periods here, thirty or fifteen days, are shorter than the sixty or seventy-five days for foreign service under Section 83 quinquies.
