Section 83 — Meeting deadlines through court service

English translation

If a party is required to file with the court, or to serve on another party or on a third person, a pleading or any other document within, or before, the time fixed by law or by the court, and such service must be effected through a court officer, that party shall be deemed to have complied with the purpose of the law or of the court once that party has delivered such pleading or document to the competent official of the court for filing or service within, or before, the fixed time, even though the receipt of the pleading or document, or the request for its service, or the actual service of the pleading or document on the other party or on the third person, takes place after the fixed time.
Where this Code provides that the service of a pleading or any other document must give the other party or a third person advance notice for a fixed period before the day on which the hearing or the taking of evidence begins, the party responsible for the service shall be deemed to have complied with the purpose of the law or of the court under the preceding paragraph only when that party has delivered the pleading or document to be served to the competent official of the court not less than three days before the commencement of the advance period so fixed.
Where a party may serve a pleading or document by delivering a copy directly to the other party or to a third person, the provisions of this Section do not prohibit the party having the duty to serve such pleading or document from using this method; but that party must file with the court the receipt of the other party or of the third person within, or before, the time fixed by law or by the court.

Why this matters in practice

This section can save a deadline: if the court officer is slow to effect service, you are still on time as long as you delivered the document to the court in time. But do not rely on it for advance-notice documents, where the three-day buffer before the notice period is mandatory, so file early.     Section 83 paragraph two only requires a party who must give the opposing party advance notice before the hearing or the taking of evidence to deliver the pleading or document to the court official not less than three days beforehand; it does not require a plaintiff to serve a copy of a power of attorney on the defendant together with the plaint.

    The defendant argued that the plaintiff should have served a copy of the power of attorney together with the plaint so the defendant could examine the plaintiff's authority to sue. The Supreme Court held that no law imposes such a requirement; Section 83 paragraph two governs only the three-day advance delivery of documents that must reach the other side before the hearing, so the objection failed.
