เมื่อคู่ความฝ่ายใดมีความจำนงที่จะอ้างอิงเอกสารฉบับใดหรือคำเบิกความของพยานคนใด หรือมีความจำนงที่จะให้ศาลตรวจบุคคล วัตถุ สถานที่ หรืออ้างอิงความเห็นของผู้เชี่ยวชาญที่ศาลตั้งหรือความเห็นของผู้มีความรู้เชี่ยวชาญ เพื่อเป็นพยานหลักฐานสนับสนุนข้ออ้างหรือข้อเถียงของตน ให้คู่ความฝ่ายนั้นยื่นบัญชีระบุพยานต่อศาลก่อนวันสืบพยานไม่น้อยกว่าเจ็ดวัน โดยแสดงเอกสารหรือสภาพของเอกสารที่จะอ้าง และรายชื่อ ที่อยู่ของบุคคล ผู้มีความรู้เชี่ยวชาญ วัตถุ หรือสถานที่ซึ่งคู่ความฝ่ายนั้นระบุอ้างเป็นพยานหลักฐาน หรือขอให้ศาลไปตรวจ หรือขอให้ตั้งผู้เชี่ยวชาญ แล้วแต่กรณี พร้อมทั้งสำเนาบัญชีระบุพยานดังกล่าวในจำนวนที่เพียงพอ เพื่อให้คู่ความฝ่ายอื่นมารับไปจากเจ้าพนักงานศาล ถ้าคู่ความฝ่ายใดมีความจำนงจะยื่นบัญชีระบุพยานเพิ่มเติม ให้ยื่นคำแถลงขอระบุพยานเพิ่มเติมต่อศาลพร้อมกับบัญชีระบุพยานเพิ่มเติมและสำเนาบัญชีระบุพยานเพิ่มเติมดังกล่าวได้ภายในสิบห้าวันนับแต่วันสืบพยานเมื่อระยะเวลาที่กำหนดให้ยื่นบัญชีพยานตามวรรคหนึ่งหรือวรรคสอง แล้วแต่กรณี ได้สิ้นสุดลงแล้ว ถ้าคู่ความฝ่ายใดซึ่งได้ยื่นบัญชีระบุพยานไว้แล้ว มีเหตุอันสมควรแสดงได้ว่า ตนไม่สามารถทราบได้ว่าต้องนำพยานหลักฐานบางอย่างมาสืบเพื่อประโยชน์ของตน หรือไม่ทราบว่าพยานหลักฐานบางอย่างได้มีอยู่ หรือมีเหตุอันสมควรอื่นใด หรือถ้าคู่ความฝ่ายใดซึ่งมิได้ยื่นบัญชีระบุพยานแสดงให้เป็นที่พอใจแก่ศาลได้ว่า มีเหตุอันสมควรที่ไม่สามารถยื่นบัญชีระบุพยานตามกำหนดเวลาดังกล่าวได้ คู่ความฝ่ายนั้นอาจยื่นคำร้องขออนุญาตอ้างพยานหลักฐานเช่นว่านั้นต่อศาลพร้อมกับบัญชีระบุพยานและสำเนาบัญชีระบุพยานดังกล่าวไม่ว่าเวลาใด ๆ ก่อนพิพากษาคดี และถ้าศาลเห็นว่า เพื่อให้การวินิจฉัยชี้ขาดข้อสำคัญแห่งประเด็นเป็นไปโดยเที่ยงธรรม จำเป็นจะต้องสืบพยานหลักฐานเช่นว่านั้น ก็ให้ศาลอนุญาตตามคำร้อง

English translation

When any party intends to rely on any document or on the testimony of any witness, or intends to have the court inspect a person, an object, or a place, or to rely on the opinion of an expert appointed by the court or the opinion of a person having expert knowledge, as evidence in support of its allegation or defense, that party shall submit a list of witnesses to the court not less than seven days before the date of taking evidence, showing the documents or the nature of the documents to be relied upon, and the names and addresses of the persons, experts, objects, or places which that party identifies as evidence, or requests the court to inspect, or requests to have an expert appointed, as the case may be, together with a sufficient number of copies of such list of witnesses for the other parties to collect from the court officer. If any party intends to submit an additional list of witnesses, it may submit a statement requesting to identify additional witnesses to the court, together with the additional list of witnesses and copies thereof, within fifteen days from the date of taking evidence. When the period for submitting the list of witnesses under paragraph one or paragraph two, as the case may be, has expired, if any party which has already submitted a list of witnesses can show reasonable cause that it could not have known that it had to adduce certain evidence for its benefit, or did not know that certain evidence existed, or has other reasonable cause, or if any party which has not submitted a list of witnesses satisfies the court that there is reasonable cause for being unable to submit the list within such period, that party may submit a motion requesting leave to rely on such evidence to the court, together with the list of witnesses and copies thereof, at any time before the judgment of the case; and if the court is of the opinion that, in order that the adjudication of the essential issues be just, it is necessary to take such evidence, the court shall grant leave as requested.

Section 88 opens Chapter 1 (General Principles) of the Code's rules on evidence and sets the gatekeeping duty of disclosure: a party must identify in advance, through a list of witnesses, every document, witness, expert, object, place, or inspection it intends to use. Paragraph one fixes the ordinary deadline of not less than seven days before the evidence-taking date, paragraph two allows an additional list within fifteen days after that date, and paragraph three lets the court, in its discretion, admit unlisted evidence up to judgment where the party shows reasonable cause and the evidence is necessary for a just decision. It operates together with Section 90 on serving copies of documentary evidence, Section 87 which confines admissible evidence to what has been listed subject to the interest-of-justice exception, and Section 246 which applies these rules on appeal.

Why this matters in practice

The list of witnesses is one of the most common places litigants lose otherwise strong evidence: miss the seven-day deadline and forget to move for leave, and the court can refuse the document or witness even if it would have decided the case. Foreign parties in particular should have counsel prepare and file the list early, because late admission turns on the court's discretion and on showing a genuine reasonable cause. Supreme Court decisions interpreting this section

  1. Supreme Court Judgment No. 4052/2567 (2024)

    Even where a party failed to list documents in its list of witnesses and to serve copies at least seven days before the hearing under Section 88 paragraph one and Section 90, the court may still admit them under Section 87(2) where they are important evidence on a key issue and justice so requires.

    The Supreme Court held that documents attached to the appeal and petition, although not listed or exchanged as Section 88 and Section 90 require, could be admitted because Section 87(2) allows the court to receive important evidence on a key issue in the interest of justice.

  2. Supreme Court Judgment No. 1267/2565 (2022)

    Facts admitted by the parties at the settlement-of-issues hearing and documents they have already filed with the court may be used to decide the case without being separately entered in a list of witnesses under Section 88.

    The court held that the appellate court properly relied on the record of proceedings and on documents the parties had filed, without requiring those matters to be entered in a Section 88 list of witnesses.

  3. Supreme Court Judgment No. 4138/2564 (2021)

    Under Section 88 paragraph three, read with Section 246 on appeal, a party may seek leave before judgment to rely on evidence not previously listed, but the court will refuse where that evidence is not necessary for a just decision of the essential issue.

    The court denied a defendant's motion to admit documents attached to the motion because they were not evidence necessary to decide the key issue justly under Section 88 paragraph three read with Section 246.
