English translation
Where it later appears, or by reason of fraud or mistake it appears, that the bail bond is too low or the security is insufficient, or that the conditions imposed are inappropriate, the officer or the court shall have the power to order the bond amount to be increased, to require additional or better security, or to alter the conditions imposed so as to make them more appropriate. After an order of provisional release has been made, if the circumstances of the case change, the officer or the court shall have the power to order a reduction of the security as it sees fit. Where the court grants provisional release and the case goes up to a higher court, the higher court shall have the power to amend the bond amount or the conditions fixed by the lower court as it sees fit.

Firm annotation
Section 115 keeps the terms of provisional release flexible after they are first set. It authorises three kinds of adjustment: upward, where the bond proves too low, the security insufficient, or the conditions inappropriate, whether that appears later or through fraud or mistake; downward, where the circumstances of the case change, allowing the security to be reduced; and on appeal, where a higher court may amend the bond amount or conditions fixed below. It complements the bond and security provisions of Sections 112 and 114 and the anti-excess principle of Section 110, ensuring the security tracks the real risk over the life of the case rather than being frozen at the moment of release.
Why this matters in practice
This section cuts both ways. If your circumstances improve, for example the case weakens or you show stronger community ties, you can apply to reduce the security. If the prosecution uncovers that a bond was set too low, expect a motion to increase it. A surety should also note that fraud or mistake in the original security can trigger an upward revision. When a case moves up on appeal, the higher court can revisit bail terms entirely. To assess whether a variation is worth seeking, consider /online-consultation-with-a-thai-lawyer/.
Frequently asked questions
Can the amount of bail be changed after it is set?
Yes. Under Section 115 the official or court may increase the bond or require more security if it was too low or the conditions unsuitable, and may reduce the security if the circumstances of the case change.
Can a higher court change bail terms set by the lower court?
Yes. Section 115 gives the higher court, when a case goes up on appeal, the power to amend the bond amount or conditions fixed by the lower court as it sees fit.
