Section 237 ter — Pre-Trial Preservation of Expert and Scientific Evidence

ให้นำความในมาตรา ๒๓๗ ทวิ
มาใช้บังคับโดยอนุโลมแก่กรณีการสืบพยานผู้เชี่ยวชาญ และพยานหลักฐานอื่น
และแก่กรณีที่ได้มีการฟ้องคดีไว้แล้วแต่มีเหตุจำเป็นที่ต้องสืบพยานหลักฐานไว้ก่อนถึงกำหนดเวลาสืบพยานตามปกติตามมาตรา
๑๗๓/๒ วรรคสองด้วยในกรณีที่พยานหลักฐานทางวิทยาศาสตร์จะสามารถพิสูจน์ให้เห็นถึงข้อเท็จจริงอันสำคัญในคดีได้
หรือมีเหตุอันควรเชื่อว่า
หากมีการเนิ่นช้ากว่าจะนำพยานหลักฐานทางวิทยาศาสตร์อันสำคัญมาสืบในภายหน้าพยานหลักฐานนั้นจะสูญเสียไปหรือเป็นการยากแก่การตรวจพิสูจน์
ผู้ต้องหาหรือพนักงานอัยการโดยตนเองหรือเมื่อได้รับคำร้องจากพนักงานสอบสวนหรือผู้เสียหาย
จะยื่นคำร้องขอให้ศาลสั่งให้ทำการตรวจพิสูจน์ทางวิทยาศาสตร์ตามความในมาตรา ๒๔๔/๑
ไว้ก่อนฟ้องก็ได้ ทั้งนี้ให้นำบทบัญญัติในมาตรา ๒๓๗ ทวิ มาใช้บังคับโดยอนุโลม

English translation

The provisions of Section 237 bis shall apply mutatis mutandis to the examination of expert witnesses and other evidence, and to a case that has already been filed but where there is a necessary cause to take evidence before the ordinary time for taking evidence under Section 173/2 paragraph two. Where scientific evidence can prove a material fact in the case, or where there is reasonable ground to believe that, if there is delay before important scientific evidence is presented in the future, that evidence will be lost or made difficult to examine, the accused or the public prosecutor, by himself or on the request of the inquiry official or the injured person, may, before prosecution, file a motion asking the court to order a scientific examination under Section 244/1; and the provisions of Section 237 bis shall apply mutatis mutandis.
