Section 8 — Rights of the defendant after charge

นับแต่เวลาที่ยื่นฟ้องแล้ว
จำเลยมีสิทธิดังต่อไปนี้
(๑)
ได้รับการพิจารณาคดีด้วยความรวดเร็ว ต่อเนื่อง และเป็นธรรม
(๒)
แต่งทนายความแก้ต่างในชั้นไต่สวนมูลฟ้อง หรือพิจารณาในศาลชั้นต้น ตลอดจนชั้นศาลอุทธรณ์และศาลฎีกา
(๓)
ปรึกษาทนายความหรือผู้ซึ่งจะเป็นทนายความเป็นการเฉพาะตัว
(๔)
ตรวจดูสิ่งที่ยื่นเป็นพยานหลักฐาน และคัดสำเนาหรือถ่ายรูปสิ่งนั้น ๆ
(๕)
ตรวจดูสำนวนการไต่สวนมูลฟ้องหรือพิจารณาของศาล และคัดสำเนาหรือขอรับสำเนาที่รับรองว่าถูกต้องโดยเสียค่าธรรมเนียม
เว้นแต่ศาลจะมีคำสั่งให้ยกเว้นค่าธรรมเนียมนั้น
(๖) ตรวจหรือคัดสำเนาคำให้การของตนในชั้นสอบสวนหรือเอกสารประกอบคำให้การของตนถ้าจำเลยมีทนายความ
ทนายความนั้นย่อมมีสิทธิเช่นเดียวกับจำเลยดังกล่าวมาแล้วด้วยเมื่อพนักงานอัยการได้ยื่นฟ้องคดีต่อศาลแล้ว
ให้ผู้เสียหายมีสิทธิตามวรรคหนึ่ง
(๖) เช่นเดียวกับจำเลยด้วย

English translation

From the time the charge is filed, the defendant has the following rights:
(1) to have the case tried speedily, continuously and fairly;
(2) to appoint counsel for the defense at the preliminary examination or the trial in the Court of First Instance, and through the Court of Appeal and the Supreme Court;
(3) to consult counsel, or a person who is to be his counsel, privately;
(4) to inspect the items submitted as evidence, and to copy or photograph them;
(5) to inspect the file of the preliminary examination or of the Court's proceedings, and to copy or obtain a certified true copy on payment of a fee, unless the Court orders that the fee be waived;
(6) to inspect or copy his own statements given at the inquiry stage, or the documents accompanying his statements.
If the defendant has counsel, that counsel likewise has the same rights as the defendant stated above. When the public prosecutor has filed the case with the Court, the injured person shall have the right under paragraph one (6) in the same way as the defendant.
