English translation
From the time the charge is filed, the defendant has the following rights:
(1) to have the case tried speedily, continuously and fairly;
(2) to appoint counsel for the defense at the preliminary examination or the trial in the Court of First Instance, and through the Court of Appeal and the Supreme Court;
(3) to consult counsel, or a person who is to be his counsel, privately;
(4) to inspect the items submitted as evidence, and to copy or photograph them;
(5) to inspect the file of the preliminary examination or of the Court's proceedings, and to copy or obtain a certified true copy on payment of a fee, unless the Court orders that the fee be waived;
(6) to inspect or copy his own statements given at the inquiry stage, or the documents accompanying his statements.
If the defendant has counsel, that counsel likewise has the same rights as the defendant stated above. When the public prosecutor has filed the case with the Court, the injured person shall have the right under paragraph one (6) in the same way as the defendant.

Firm annotation
Section 8 codifies the defendant's fair-trial rights once prosecution begins, complementing the pre-trial protections of Section 7/1. It guarantees access to counsel at every instance, disclosure and copying of evidence and the case file, and a speedy, continuous and fair hearing. Defense counsel share these rights, and paragraph one (6) is extended to the injured person after the public prosecutor files. The right to counsel here works alongside Sections 134/1, 173 and related provisions that require the court to secure representation in serious cases.
Why this matters in practice
After you are charged, Section 8 lets you and your lawyer see and copy the prosecution evidence and the court file, which is essential for building a defense. Use the right to inspect early so nothing surprises you at trial, and appoint counsel for every level, since the right runs through the Court of Appeal and Supreme Court. Choosing the right lawyer matters, so review how to choose a lawyer in Thailand.
