Section 1625: Dividing property between the deceased and the surviving spouse

ถ้าผู้ตายเป็นผู้สมรสแล้ว การคิดส่วนแบ่งและการปันทรัพย์สินระหว่างผู้ตายกับคู่สมรสที่ยังมีชีวิตอยู่นั้นให้เป็นไปดังนี้
(๑) ในเรื่องส่วนแบ่งในทรัพย์สินระหว่างคู่สมรส ให้อยู่ในบังคับของบทบัญญัติแห่งประมวลกฎหมายนี้ว่าด้วยการหย่าโดยยินยอมทั้งสองฝ่าย อันมีบทบัญญัติเพิ่มเติมให้บริบูรณ์ในมาตรา ๑๖๓๗ และ ๑๖๓๘ และโดยเฉพาะ ต้องอยู่ในบังคับแห่งมาตรา ๑๕๑๓ ถึง ๑๕๑๗ แห่งประมวลกฎหมายนี้ แต่การคิดส่วนแบ่งนั้นมีผลตั้งแต่วันที่การสมรสได้สิ้นไปด้วยเหตุความตายนั้น

English translation
If the deceased was married, the calculation and division of property between the deceased and the surviving spouse is as follows:
(1) as regards the division of the property between the spouses, the provisions of this Code on divorce by mutual consent apply, as supplemented by Section 1637 and Section 1638, and in particular Sections 1513 to 1517 of this Code apply; but the division takes effect from the day the marriage came to an end by reason of the death;
(2) as regards the division of the estate of the deceased, the provisions of this Book apply, other than Section 1637 and Section 1638.

Why this matters in practice
For lawyers: step one, identify all sinsomros (jointly acquired marital property). The surviving spouse takes half; the other half becomes the deceased's estate. Step two, distribute the estate to heirs under §§1629 and 1635. For clients: the surviving spouse does not inherit the entire jointly owned property automatically; they own half outright (not as inheritance) and then inherit an additional share of the remaining half as a statutory heir under §1635.
Legislative history
Section 1625 was amended by the Act Amending the Civil and Commercial Code (No. 24) B.E. 2567, the Marriage Equality Act, gazetted 24 September 2567 and in force 23 January 2025. Paragraph (1) now speaks of the division of property between SPOUSES where it previously read between husband and wife, so the section is no longer expressed in gendered terms and its regime applies to spouses of any gender. Its function is unchanged: it bridges the matrimonial property regime in Book 5 and the law of succession in Book 6 by requiring a two step process, first separating the marital property, then distributing the deceased's share as estate.

Supreme Court Judgment No. 3566/2542 (1999)
A void will does not extinguish the surviving spouse's rights under §§1625 and 1635; the spouse retains both the marital property share and the statutory heir share.
The deceased's will was void for lack of a date. Even though the will was void, the surviving spouse still had rights in the estate assets in her capacity as spouse under §§1625 and 1635(2): she was entitled to her marital property share and to her statutory heir share of the remaining estate.

Supreme Court Judgment No. 6562/2537 (1994)
Where one of the spouses dies, section 1625 requires the property of the husband and wife to be divided between the surviving spouse and the estate, and the division is made under section 1533, so the surviving spouse takes one half of the sin somros. A person who withdraws sin somros belonging to the surviving spouse must return that half, with interest.
The plaintiff, as surviving spouse, claimed her share of the sin somros consisting of cash in the deceased's bank accounts, amounting to 3,652,065.20 baht, which the first and second defendants had withdrawn from the third defendant. The first and second defendants did not deny it and had themselves accepted, at item 26 of the schedule of property annexed to the minutes of the heirs' meeting, that the sum was sin somros between the deceased and the plaintiff. The Supreme Court accordingly held the sum to be sin somros, and that the plaintiff was entitled to half of it under section 1625 read with section 1533, namely 1,826,032.60 baht, which the first and second defendants had to return to her with interest.
