ถ้าส่วนหนึ่งส่วนใดของนิติกรรมเป็นโมฆะ นิติกรรมนั้นย่อมตกเป็นโมฆะทั้งสิ้น เว้นแต่จะพึงสันนิษฐานได้โดยพฤติการณ์แห่งกรณีว่า คู่กรณีเจตนาจะให้ส่วนที่ไม่เป็นโมฆะนั้นแยกออกจากส่วนที่เป็นโมฆะได้

English translation
If any part of an act is void the whole act is void, unless it may be assumed under the circumstances of the case that the parties intended the valid part of the act to be separable from the invalid part.
