ถ้าส่วนหนึ่งส่วนใดของนิติกรรมเป็นโมฆะ นิติกรรมนั้นย่อมตกเป็นโมฆะทั้งสิ้น เว้นแต่จะพึงสันนิษฐานได้โดยพฤติการณ์แห่งกรณีว่า คู่กรณีเจตนาจะให้ส่วนที่ไม่เป็นโมฆะนั้นแยกออกจากส่วนที่เป็นโมฆะได้
