วรรคสอง แห่งประมวลกฎหมายแพ่งและพาณิชย์ ซึ่งแก้ไขเพิ่มเติมโดยพระราชบัญญัตินี้ มิให้ใช้บังคับแก่สัญญาขายฝากที่ได้ทำไว้ก่อนวันที่พระราชบัญญัตินี้ใช้บังคับหมายเหตุ :- เหตุผลในการประกาศใช้พระราชบัญญัติฉบับนี้ คือ เนื่องจากประมวลกฎหมายแพ่งและพาณิชย์ในเรื่องขายฝากมีบทบัญญัติยังไม่เหมาะสม เป็นเหตุให้มีการเอาเปรียบผู้ขายฝากโดยการกำหนดสินไถ่ที่สูงเกินควร เพื่อหลีกเลี่ยงกฎหมายห้ามเรียกดอกเบี้ยเกินอัตรา รวมทั้งในกรณีที่ถึงกำหนดเวลาไถ่ผู้ซื้อฝากมักจะหลีกเลี่ยงไม่ยอมให้มีการไถ่ จนเป็นเหตุให้ผู้ขายฝากต้องสูญเสียกรรมสิทธิ์ในทรัพย์สินไปโดยไม่ชอบธรรม นอกจากนี้ เห็นควรปรับปรุงระยะเวลาในการใช้สิทธิไถ่ในสัญญาขายฝากให้เหมาะสมยิ่งขึ้น จึงจำเป็นต้องตราพระราชบัญญัตินี้พระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายแพ่งและพาณิชย์ (ฉบับที่ ๑๓) พ.ศ. ๒๕๔๑[312]

English translation
If no price of redemption id fixed, the property may be redeemed by reimbursing the price of the sale. If the price of redemption or the price of the sale, at the time of redemption, is higher than the real price of the sale more than fifteen percent per year, it shall be feedback (/form/1-samuiforsale-contact-form.html?tmpl=component) / redeemed at a real price including fifteen percent per year of profit.
