อันว่ายืมใช้สิ้นเปลืองนั้น คือสัญญาซึ่งผู้ให้ยืมโอนกรรมสิทธิ์ในทรัพย์สินชนิดใช้ไปสิ้นไปนั้นเป็นปริมาณมีกำหนดให้ไปแก่ผู้ยืม และผู้ยืมตกลงว่าจะคืนทรัพย์สินเป็นประเภท ชนิด และปริมาณเช่นเดียวกันให้แทนทรัพย์สินซึ่งให้ยืมนั้นสัญญานี้ย่อมบริบูรณ์ต่อเมื่อส่งมอบทรัพย์สินที่ยืม

English translation

A loan for consumption is a contract whereby the lender transfers to the borrower the ownership of a certain quantity of property which is consumed in the user, and the borrower agrees to return a property of the same kind, quality and quantity. The contract is complete only on delivery of the property.
