เมื่อเจ้าหนี้ทวงให้ผู้ค้ำประกันชำระหนี้ ผู้ค้ำประกันจะขอให้เรียกลูกหนี้ชำระก่อนก็ได้ เว้นแต่ลูกหนี้จะถูกศาลพิพากษาให้เป็นคนล้มละลายเสียแล้ว หรือไม่ปรากฏว่าลูกหนี้ไปอยู่แห่งใดในพระราชอาณาเขต

English translation
Where the creditor demands performance from the surety, the surety may require that the debtor be called on first, unless the debtor has been adjudged bankrupt by the court, or it is unknown where in the Kingdom the debtor is.
