เมื่อเจ้าหนี้ทวงให้ผู้ค้ำประกันชำระหนี้ ผู้ค้ำประกันจะขอให้เรียกลูกหนี้ชำระก่อนก็ได้ เว้นแต่ลูกหนี้จะถูกศาลพิพากษาให้เป็นคนล้มละลายเสียแล้ว หรือไม่ปรากฏว่าลูกหนี้ไปอยู่แห่งใดในพระราชอาณาเขต
