ถึงแม้จะได้เรียกให้ลูกหนี้ชำระหนี้ดังกล่าวมาในมาตราก่อนนั้นแล้วก็ตาม ถ้าผู้ค้ำประกันพิสูจน์ได้ว่าลูกหนี้นั้นมีทางที่จะชำระหนี้ได้ และการที่จะบังคับให้ลูกหนี้ชำระหนี้นั้นจะไม่เป็นการยากไซร้ ท่านว่าเจ้าหนี้จะต้องบังคับการชำระหนี้รายนั้นเอาจากทรัพย์สินของลูกหนี้ก่อน

English translation
Even after the debtor has been called on as provided in the preceding Section, if the surety proves that the debtor has the means to perform and that enforcement against the debtor would not be difficult, the creditor must first enforce the obligation against the debtor's property.
