นิติบุคคลต้องมีผู้แทนคนหนึ่งหรือหลายคน ทั้งนี้ ตามที่กฎหมาย ข้อบังคับ หรือตราสารจัดตั้งจะได้กำหนดไว้ความประสงค์ของนิติบุคคลย่อมแสดงออกโดยผู้แทนของนิติบุคคล
