Section 744 — How a mortgage is extinguished

อันจำนองย่อมระงับสิ้นไป (๑) เมื่อหนี้ที่ประกันระงับสิ้นไปด้วยเหตุประการอื่นใดมิใช่เหตุอายุความ (๒) เมื่อปลดจำนองให้แก่ผู้จำนองด้วยหนังสือเป็นสำคัญ (๓) เมื่อผู้จำนองหลุดพ้น (๔) เมื่อถอนจำนอง (๕) เมื่อขายทอดตลาดทรัพย์สินซึ่งจำนองตามคำสั่งศาลอันเนื่องมาแต่การบังคับจำนองหรือถอนจำนอง หรือเมื่อมีการขายทอดตลาดทรัพย์สินตามมาตรา ๗๒๙/๑ (๖) เมื่อเอาทรัพย์สินซึ่งจำนองนั้นหลุด

English translation

A mortgage is extinguished:

(1) when the obligation secured is extinguished otherwise than by prescription;

(2) when the mortgage is released to the mortgagor in writing;

(3) when the mortgagor is discharged;

(4) when the mortgage is withdrawn;

(5) when the mortgaged property is sold by public auction by order of the court as a result of enforcement of the mortgage or of withdrawal of the mortgage, or when the property is sold by public auction under Section 729/1;

(6) when the mortgaged property is foreclosed.
