Section 271 — Court with power of execution

ศาลที่มีอำนาจในการบังคับคดีซึ่งมีอำนาจกำหนดวิธีการบังคับคดีตามมาตรา ๒๗๖ และมีอำนาจทำคำวินิจฉัยชี้ขาดหรือทำคำสั่งในเรื่องใด ๆ อันเกี่ยวด้วยการบังคับคดีตามคำพิพากษาหรือคำสั่ง คือศาลที่ได้พิจารณาและชี้ขาดตัดสินคดีในชั้นต้น หรือตามที่มีกฎหมายบัญญัติ
ถ้าศาลอุทธรณ์หรือศาลฎีกาได้ส่งคดีไปยังศาลชั้นต้นแห่งอื่นที่มิได้มีคำพิพากษาหรือคำสั่งที่อุทธรณ์หรือฎีกานั้นเพื่อการพิจารณาและพิพากษาใหม่ตามมาตรา ๒๔๓
(๒) และ
(๓) ให้ศาลที่มีคำพิพากษาหรือคำสั่งใหม่นั้นเป็นศาลที่มีอำนาจในการบังคับคดี เว้นแต่ศาลอุทธรณ์หรือศาลฎีกา แล้วแต่กรณี จะได้กำหนดไว้เป็นอย่างอื่น
ในกรณีที่จะต้องบังคับคดีนอกเขตศาล ให้ศาลที่มีอำนาจในการบังคับคดีมีอำนาจตั้งให้ศาลอื่นบังคับคดีแทนได้ หรือเจ้าหนี้ตามคำพิพากษาอาจยื่นคำแถลงหรือเจ้าพนักงานบังคับคดีรายงานให้ศาลที่จะมีการบังคับคดีแทนทราบพร้อมด้วยสำเนาหมายบังคับคดีหรือสำเนาคำสั่งกำหนดวิธีการบังคับคดี ในกรณีเช่นว่านี้ ให้ศาลดังกล่าวแจ้งให้ศาลที่มีอำนาจในการบังคับคดีทราบโดยไม่ชักช้า และให้ศาลที่จะมีการบังคับคดีแทนตั้งเจ้าพนักงานบังคับคดีหรือมีคำสั่งอื่นใดเพื่อดำเนินการบังคับคดีต่อไป
ถ้าเป็นการยึดทรัพย์สินหรืออายัดสิทธิเรียกร้อง ให้ศาลที่บังคับคดีแทนส่งทรัพย์สินที่ได้จากการยึดหรืออายัดหรือเงินที่ได้จากการขายทรัพย์สินนั้น แล้วแต่กรณี ไปยังศาลที่มีอำนาจในการบังคับคดีเพื่อดำเนินการไปตามกฎหมาย

English translation

The court with power of execution, being the court with power to determine the method of execution under Section 276 and to render a decision or make an order on any matter relating to the enforcement of a judgment or order, is the court that tried and adjudicated the case at first instance, or as otherwise provided by law.
If the Court of Appeal or the Supreme Court has remitted the case to another court of first instance which did not render the judgment or order appealed against, for retrial and a new judgment under Section 243(2) and (3), the court that renders the new judgment or order shall be the court with power of execution, unless the Court of Appeal or the Supreme Court, as the case may be, has provided otherwise.
Where execution must be carried out beyond the court's jurisdiction, the court with power of execution may appoint another court to enforce on its behalf; or the judgment creditor may file a statement, or the executing officer may report, to the court where execution is to be carried out on its behalf, together with a copy of the writ of execution or a copy of the order determining the method of execution. In such a case, that court shall notify the court with power of execution without delay, and the court carrying out execution on its behalf shall appoint an executing officer or make any other order to proceed with the execution.
In the case of seizure of property or attachment of a claim, the court carrying out execution on behalf shall send the property obtained from the seizure or attachment, or the money obtained from the sale of such property, as the case may be, to the court with power of execution to proceed according to law.
Where execution beyond the court's jurisdiction is carried out defectively, erroneously, or unlawfully, the court carrying out execution on behalf shall have power to order the revocation or correction of all execution proceedings or any particular execution method, or to make an order directing any method to the executing officer to correct the defect, error, or unlawfulness, including conducting any related proceedings, except that once execution has been completed and the result reported to the court with power of execution, the matter shall be within the power of the court with power of execution alone.

Section 271 opens Book 4, Title 2, Part 1 on the court with power of execution and is the anchor for the whole enforcement stage. It fixes the forum: the court of first instance that decided the case both determines the method of execution under Section 276 and decides every question arising in enforcement. Where the Court of Appeal or Supreme Court remits a case for retrial under Section 243(2) and (3), execution power follows to the court that renders the new judgment. The later paragraphs, added to modernise cross-jurisdiction enforcement, let the execution court delegate to a court in the area where assets lie, allow that court to correct defective out-of-area execution, and require it to remit seized property or proceeds back to the execution court.

Why this matters in practice

Getting the forum right matters. If you believe an auction or other execution step was unlawful, the remedy is a motion in the original case before the execution court under Section 271, read with Section 7(2), not a fresh lawsuit; a separate action to undo the auction can be dismissed for want of authority. The same court also rules on disputes over how far a judgment is being enforced, such as a boundary or survey question in a land case. For creditors chasing assets across provinces, this section is what makes enforcing a judgment in another court's area workable.

  1. Supreme Court Judgment No. 2564/2567 (2024)

    A party alleging that an auction in execution was unlawful must raise it by motion in the original case before the court that issued the writ, under Section 7(2) read with Section 271, so that court can inquire and revoke or correct the execution; the party has no power to bring a fresh lawsuit seeking to set aside the auction.

    The plaintiff claimed an auction of disputed land was unlawful because the judgment debtor was not the true owner and the title deed had been issued unlawfully. The Supreme Court held that the challenge had to be made by motion in the original case before the court that issued the writ, under Section 7(2) with Section 271, and that the plaintiff had no power to file a new action to set aside the auction, even though the claim also touched cancellation of the title deed.

  2. Supreme Court Judgment No. 1467/2566 (2023)

    A party who disputes how a judgment is being enforced, such as the scope of a land survey carried out in execution, may apply to the execution court under Section 271 for an order determining the method of execution and a ruling on the enforcement question.

    The applicants contended that enforcement was carried out incorrectly because the land office surveyed and issued a new title deed beyond the disputed map. They asked the court to determine the method of execution and rule on the enforcement question under Section 271, treating the execution court as the proper forum for that dispute rather than a separate action.
