ในกรณีที่คำบังคับ หมายบังคับคดี หรือคำสั่งศาลในชั้นบังคับคดีบกพร่อง ผิดพลาด หรือฝ่าฝืนกฎหมาย เพื่อประโยชน์แห่งความยุติธรรมจำเป็นจะต้องเพิกถอนหรือแก้ไขคำบังคับ หมายบังคับคดี หรือคำสั่งดังกล่าวนั้น เมื่อศาลเห็นสมควรไม่ว่าในเวลาใดก่อนการบังคับคดีได้เสร็จลง หรือเมื่อเจ้าพนักงานบังคับคดีรายงานต่อศาล หรือเมื่อเจ้าหนี้ตามคำพิพากษา ลูกหนี้ตามคำพิพากษา หรือบุคคลภายนอกผู้มีส่วนได้เสียในการบังคับคดีซึ่งต้องเสียหายเพราะเหตุดังกล่าว ยื่นคำร้องต่อศาล ให้ศาลมีอำนาจสั่งเพิกถอนหรือแก้ไขคำบังคับ หมายบังคับคดี หรือคำสั่งดังกล่าวทั้งหมดหรือบางส่วน หรือมีคำสั่งอย่างใดตามที่ศาลเห็นสมควร
ภายใต้บังคับมาตรา ๓๓๑ วรรคสาม ถ้าเจ้าพนักงานบังคับคดีได้ดำเนินการบังคับคดีบกพร่อง ผิดพลาด หรือฝ่าฝืนกฎหมาย เมื่อศาลเห็นสมควรไม่ว่าในเวลาใดก่อนการบังคับคดีได้เสร็จลง หรือเมื่อเจ้าหนี้ตามคำพิพากษา ลูกหนี้ตามคำพิพากษา หรือบุคคลภายนอกผู้มีส่วนได้เสียในการบังคับคดีซึ่งต้องเสียหายเพราะเหตุดังกล่าว ยื่นคำร้องต่อศาล ให้ศาลมีอำนาจสั่งเพิกถอนหรือแก้ไขกระบวนวิธีการบังคับคดีทั้งปวงหรือวิธีการบังคับใด ๆ โดยเฉพาะหรือมีคำสั่งกำหนดวิธีการอย่างใดแก่เจ้าพนักงานบังคับคดีตามที่ศาลเห็นสมควร
การยื่นคำร้องตามวรรคหนึ่งหรือวรรคสองอาจกระทำได้ไม่ว่าในเวลาใดก่อนการบังคับคดีได้เสร็จลง แต่ต้องไม่ช้ากว่าสิบห้าวันนับแต่วันที่ได้ทราบข้อความหรือพฤติการณ์อันเป็นมูลแห่งข้ออ้างนั้น ทั้งนี้ ผู้ยื่นคำร้องต้องมิได้ดำเนินการอันใดขึ้นใหม่หลังจากได้ทราบเรื่องบกพร่อง ผิดพลาด หรือฝ่าฝืนกฎหมายนั้นแล้ว หรือต้องมิได้ให้สัตยาบันแก่การกระทำนั้น และในกรณีเช่นว่านี้ผู้ยื่นคำร้องจะขอต่อศาลในขณะเดียวกันนั้นให้มีคำสั่งงดการบังคับคดีไว้ในระหว่างวินิจฉัยชี้ขาดก็ได้
เพื่อประโยชน์แห่งมาตรานี้ให้ถือว่าการบังคับคดีได้เสร็จลงเมื่อได้มีการดำเนินการดังต่อไปนี้
(๑) ในกรณีที่คำบังคับกำหนดให้ส่งทรัพย์สิน กระทำการ หรืองดเว้นกระทำการอย่างใด เมื่อได้มีการปฏิบัติตามคำบังคับที่ให้ส่งทรัพย์สิน กระทำการ หรืองดเว้นกระทำการอย่างนั้นแล้ว แต่ถ้าการปฏิบัติตามคำบังคับดังกล่าวอาจแยกเป็นส่วน ๆ ได้ เมื่อได้มีการปฏิบัติตามคำบังคับในส่วนใดแล้ว ให้ถือว่าการบังคับคดีได้เสร็จลงเฉพาะในส่วนนั้น
(๒) ในกรณีที่คำบังคับกำหนดให้ใช้เงิน เมื่อเจ้าพนักงานบังคับคดีได้จ่ายเงินตามมาตรา ๓๓๙ มาตรา ๓๔๐ มาตรา ๓๔๒ มาตรา ๓๔๓ หรือมาตรา ๓๔๔ แล้วแต่กรณี แล้ว แต่ถ้าทรัพย์สินที่ถูกบังคับคดีมีหลายรายการ เมื่อเจ้าพนักงานบังคับคดีได้จ่ายเงินที่ได้จากการขายทอดตลาดทรัพย์สินรายการใดแล้ว ให้ถือว่าการบังคับคดีได้เสร็จลงเฉพาะทรัพย์สินรายการนั้น
ในการยื่นคำร้องต่อศาลตามวรรคหนึ่งหรือวรรคสอง หากมีพยานหลักฐานเบื้องต้นแสดงว่าคำร้องนั้นไม่มีมูลและยื่นเข้ามาเพื่อประวิงให้ชักช้า ศาลมีอำนาจสั่งให้ผู้ยื่นคำร้องวางเงินหรือหาประกันต่อศาลตามจำนวนและภายในระยะเวลาที่ศาลเห็นสมควรเพื่อเป็นประกันการชำระค่าสินไหมทดแทนแก่เจ้าหนี้ตามคำพิพากษาหรือบุคคลนั้นสำหรับความเสียหายที่อาจได้รับจากการยื่นคำร้องนั้น ถ้าผู้ยื่นคำร้องไม่ปฏิบัติตามคำสั่งศาล ให้ศาลมีคำสั่งยกคำร้องนั้นเสีย ส่วนเงินหรือประกันที่วางไว้ต่อศาลดังกล่าว เมื่อศาลเห็นว่าไม่มีความจำเป็นต่อไป จะสั่งคืนหรือยกเลิกประกันนั้นก็ได้ คำสั่งของศาลที่ออกตามความในวรรคนี้ให้เป็นที่สุด
ในกรณีที่ศาลได้มีคำสั่งยกคำร้องที่ยื่นไว้ตามวรรคหนึ่งหรือวรรคสอง ถ้าบุคคลที่ได้รับความเสียหายเนื่องจากการยื่นคำร้องดังกล่าวเห็นว่าคำร้องนั้นไม่มีมูลและยื่นเข้ามาเพื่อประวิงให้ชักช้า บุคคลดังกล่าวอาจยื่นคำร้องต่อศาลภายในสามสิบวันนับแต่วันที่มีคำสั่งยกคำร้อง เพื่อขอให้ศาลสั่งให้ผู้ยื่นคำร้องนั้นชดใช้ค่าสินไหมทดแทน ในกรณีเช่นว่านี้ ให้ศาลมีอำนาจสั่งให้แยกการพิจารณาเป็นสำนวนต่างหากจากคดีเดิม และเมื่อศาลไต่สวนแล้วเห็นว่าคำร้องนั้นฟังได้ ให้ศาลมีคำสั่งให้ผู้ยื่นคำร้องนั้นชดใช้ค่าสินไหมทดแทนให้แก่บุคคลที่ได้รับความเสียหายดังกล่าวตามจำนวนที่ศาลเห็นสมควร ถ้าผู้ยื่นคำร้องนั้นไม่ปฏิบัติตามคำสั่งศาล บุคคลที่ได้รับความเสียหายอาจร้องขอให้ศาลบังคับคดีแก่ผู้ยื่นคำร้องนั้นเสมือนหนึ่งว่าเป็นลูกหนี้ตามคำพิพากษา
English translation
Where a writ of demand, a writ of execution, or a court order at the execution stage is defective, erroneous, or contrary to law, and it is necessary, in the interest of justice, to set aside or correct that writ of demand, writ of execution, or order, then, when the court thinks fit at any time before the execution has been completed, or when the executing officer reports to the court, or when the judgment creditor, the judgment debtor, or a third party having an interest in the execution who must suffer damage by reason of such cause files a motion with the court, the court shall have the power to order the setting aside or correction of the writ of demand, writ of execution, or order, in whole or in part, or to make any order as it thinks fit.
Subject to Section 331, paragraph three, if the executing officer has carried out the execution defectively, erroneously, or contrary to law, then, when the court thinks fit at any time before the execution has been completed, or when the judgment creditor, the judgment debtor, or a third party having an interest in the execution who must suffer damage by reason of such cause files a motion with the court, the court shall have the power to order the setting aside or correction of all the execution proceedings or of any particular method of execution, or to prescribe any method to the executing officer as it thinks fit.
The filing of a motion under paragraph one or paragraph two may be done at any time before the execution has been completed, but not later than fifteen days from the day on which the applicant became aware of the fact or circumstance that is the ground of the objection, provided that the applicant has not taken any fresh step after becoming aware of the defect, error, or violation of law, or has not ratified that act; and in such case the applicant may at the same time request the court to order a stay of the execution pending the adjudication.
For the purpose of this Section, the execution shall be deemed completed when the following has been done:
(1) where the writ of demand requires the delivery of property, the doing of an act, or the refraining from an act, when the writ has been complied with; but if compliance can be divided into parts, when the writ has been complied with as to any part, the execution shall be deemed completed only as to that part;
(2) where the writ of demand requires the payment of money, when the executing officer has paid out the money under Section 339, Section 340, Section 342, Section 343, or Section 344, as the case may be; but if the property under execution comprises several items, when the executing officer has paid out the money obtained from the auction of any item, the execution shall be deemed completed only as to that item.
In filing a motion under paragraph one or paragraph two, if there is prima facie evidence showing that the motion is without merit and was filed to cause delay, the court has the power to order the applicant to deposit money or furnish security in the amount and within the period it thinks fit, as security for payment of compensation to the judgment creditor or that person for the damage that may be sustained from the filing of the motion. If the applicant does not comply, the court shall dismiss the motion. When the court sees that the money or security is no longer necessary, it may order its return or the cancellation of the security. An order of the court under this paragraph shall be final.
Where the court has dismissed a motion filed under paragraph one or paragraph two, if the person who has suffered damage from the filing considers that the motion was without merit and filed to cause delay, that person may file a motion with the court within thirty days from the day of the order of dismissal, requesting the court to order the applicant to pay compensation. In such case, the court may order the matter to be tried separately from the original case, and when the court, after inquiry, is of the opinion that the motion is sustainable, it shall order that applicant to pay compensation to the person who has suffered damage in the amount it thinks fit. If that applicant does not comply, the person who has suffered damage may request the court to execute against that applicant as if he were a judgment debtor.

Section 295 opens Part 10 and is the central remedy for irregular execution. Paragraph one targets defective writs and execution-stage orders, while paragraph two, subject to Section 331 paragraph three, targets the officer's own defective conduct, and both may be raised by the court, the officer, or an aggrieved party. The section builds in strict gatekeeping: a fifteen-day deadline from awareness, a bar where the mover took fresh steps or ratified the act, and a precise definition of when execution is deemed completed, after which relief is unavailable. To deter abuse, paragraphs five and six let the court demand security for a frivolous delaying motion and let a damaged party claim compensation. This is the current numbering after the 2017 reform; the equivalent remedy was formerly in the old Section 296.

This is the provision to reach for when an execution has gone wrong, a wrongly issued writ, an auction conducted unlawfully, an overreaching seizure, but the fifteen-day clock and the completed-execution cut-off are unforgiving, so speed matters. Supreme Court Judgment No. 3001/2568 (2025)
A writ of execution issued where there was no longer any right to enforce is defective and may be set aside under Section 295; because the point concerns public order, the court may raise it on its own even if no party has done so.
A writ of execution to evict had been issued although there was no longer a right to enforce under the compromise judgment. The Supreme Court held the writ was defective and could be set aside under Section 295, and being a matter of public order it could raise the issue on its own under Section 142 (5) with Sections 246 and 252, so it declined to follow the Court of Appeal's stay.

A motion to set aside an auction is a motion under Section 295 paragraph two; where the court orders the applicant to deposit security under paragraph five and the applicant fails to do so, the resulting dismissal is final and cannot be appealed.
The applicant moved to set aside an auction under Section 295 paragraph two. The court ordered a 1,000,000 baht security deposit under paragraph five; when the applicant did not deposit it, the court struck the motion, which amounted to a dismissal. The Court held that under the closing words of paragraph five the order was final.

Where an auction is conducted contrary to law, such as in breach of Section 331 paragraph three so that an interested person cannot fully exercise the right to bid, the court has power to set aside the auction under Section 295 paragraph two.
The auction was carried out in a way that denied an interested person, who held a preferential right over the land, the full right to bid, contrary to Section 331 paragraph three. The Court held the auction was unlawful and that the court could set it aside under Section 295 paragraph two, affirming the lower court's cancellation.
