ถ้าผู้เอาประกันภัยได้เอาประกันภัยไว้โดยกำหนดว่า เมื่อตนถึงซึ่งความมรณะให้ใช้เงินแก่ทายาททั้งหลายของตนโดยมิได้เจาะจงระบุชื่อผู้หนึ่งผู้ใดไว้ไซร้ จำนวนเงินอันจะพึงใช้นั้นท่านให้ฟังเอาเป็นสินทรัพย์ส่วนหนึ่งแห่งกองมรดกของผู้เอาประกันภัย ซึ่งเจ้าหนี้จะเอาใช้หนี้ได้ถ้าได้เอาประกันภัยไว้โดยกำหนดว่าให้ใช้เงินแก่บุคคลคนใดคนหนึ่งโดยเฉพาะเจาะจง ท่านว่าเฉพาะแต่จำนวนเงินเบี้ยประกันภัยซึ่งผู้เอาประกันภัยได้ส่งไปแล้วเท่านั้นจักเป็นสินทรัพย์ส่วนหนึ่งแห่งกองมรดกของผู้เอาประกันภัยอันเจ้าหนี้จะเอาใช้หนี้ได้
