ถ้ามรณภัยเกิดขึ้นเพราะความผิดของบุคคลภายนอก ผู้รับประกันภัยหาอาจจะเรียกเอาค่าสินไหมทดแทนจากบุคคลภายนอกนั้นได้ไม่ แต่สิทธิของฝ่ายทายาทแห่งผู้มรณะในอันจะได้ค่าสินไหมทดแทนจากบุคคลภายนอกนั้นหาสูญสิ้นไปด้วยไม่ แม้ทั้งจำนวนเงินอันจะพึงใช้ตามสัญญาประกันชีวิตนั้นจะหวนกลับมาได้แก่ตนด้วย
