ถ้ามรณภัยเกิดขึ้นเพราะความผิดของบุคคลภายนอก ผู้รับประกันภัยหาอาจจะเรียกเอาค่าสินไหมทดแทนจากบุคคลภายนอกนั้นได้ไม่ แต่สิทธิของฝ่ายทายาทแห่งผู้มรณะในอันจะได้ค่าสินไหมทดแทนจากบุคคลภายนอกนั้นหาสูญสิ้นไปด้วยไม่ แม้ทั้งจำนวนเงินอันจะพึงใช้ตามสัญญาประกันชีวิตนั้นจะหวนกลับมาได้แก่ตนด้วย

English translation
Where death is caused by the fault of a third person, the insurer has no claim for compensation against that third person.
The right of the heirs of the deceased to compensation from that third person is not extinguished, even though the sum payable under the contract of life insurance also comes to them.
