ถ้าผู้เอาประกันภัยได้เอาประกันภัยไว้โดยกำหนดว่า เมื่อตนถึงซึ่งความมรณะให้ใช้เงินแก่ทายาททั้งหลายของตนโดยมิได้เจาะจงระบุชื่อผู้หนึ่งผู้ใดไว้ไซร้ จำนวนเงินอันจะพึงใช้นั้นท่านให้ฟังเอาเป็นสินทรัพย์ส่วนหนึ่งแห่งกองมรดกของผู้เอาประกันภัย ซึ่งเจ้าหนี้จะเอาใช้หนี้ได้ถ้าได้เอาประกันภัยไว้โดยกำหนดว่าให้ใช้เงินแก่บุคคลคนใดคนหนึ่งโดยเฉพาะเจาะจง ท่านว่าเฉพาะแต่จำนวนเงินเบี้ยประกันภัยซึ่งผู้เอาประกันภัยได้ส่งไปแล้วเท่านั้นจักเป็นสินทรัพย์ส่วนหนึ่งแห่งกองมรดกของผู้เอาประกันภัยอันเจ้าหนี้จะเอาใช้หนี้ได้

English translation
Where the insured has taken out insurance providing that, on his death, the sum is to be paid to his heirs without naming any particular person, the sum payable forms part of his estate and may be taken by his creditors in satisfaction of their debts.
Where the insurance provides that the sum is to be paid to a particular named person, only the premiums the insured has paid form part of his estate and may be taken by his creditors in satisfaction of their debts.
