เมื่อใดจะต้องใช้จำนวนเงินในเหตุมรณะของบุคคลคนหนึ่งคนใด ท่านว่าผู้รับประกันภัยจำต้องใช้เงินนั้นในเมื่อมรณภัยอันนั้นเกิดขึ้น เว้นแต่(๑) บุคคลผู้นั้นได้กระทำอัตตวินิบาตด้วยใจสมัครภายในปีหนึ่งนับแต่วันทำสัญญา หรือ(๒) บุคคลผู้นั้นถูกผู้รับประโยชน์ฆ่าตายโดยเจตนาในกรณีที่ ๒ นี้ ท่านว่าผู้รับประกันภัยจำต้องใช้เงินค่าไถ่ถอนกรมธรรม์ให้แก่ผู้เอาประกันภัย หรือให้แก่ทายาทของผู้นั้น

English translation
Where a sum is payable on the death of a person, the insurer must pay it when that death occurs, except where:
(1) that person committed suicide voluntarily within one year from the date of the contract; or
(2) that person was intentionally killed by the beneficiary.
In case (2) the insurer must pay the surrender value of the policy to the insured or to his heirs.
