ผู้ทรงตั๋วแลกเงินจะใช้สิทธิไล่เบี้ยเอาแก่บรรดาผู้สลักหลัง ผู้สั่งจ่าย และบุคคลอื่น ๆ ซึ่งต้องรับผิดตามตั๋วเงินนั้นก็ได้ คือก) ไล่เบี้ยได้เมื่อตั๋วเงินถึงกำหนดในกรณีไม่ใช้เงินข) ไล่เบี้ยได้แม้ทั้งตั๋วเงินยังไม่ถึงกำหนดในกรณีดังจะกล่าวต่อไปนี้ คือ(๑) ถ้าเขาบอกปัดไม่รับรองตั๋วเงิน(๒) ถ้าผู้จ่ายหากจะได้รับรองหรือไม่ก็ตาม ตกเป็นคนล้มละลาย หรือได้งดเว้นการใช้หนี้ แม้การงดเว้นใช้หนี้นั้น จะมิได้มีคำพิพากษาเป็นหลักฐานก็ตาม หรือถ้าผู้จ่ายถูกยึดทรัพย์และการยึดทรัพย์นั้นไร้ผล(๓) ถ้าผู้สั่งจ่ายตั๋วเงินชนิดไม่จำเป็นต้องให้ผู้ใดรับรองนั้นตกเป็นคนล้มละลาย

English translation

The holder of a bill of exchange may exercise his right of recourse against the endorsers, the drawer and other parties liable on the bill: (a) at maturity, in case of non-payment; (b) even before maturity, in the following cases: (1) if acceptance has been refused; (2) if the drawee, whether he has accepted or not, becomes bankrupt or suspends payment, even though the suspension is not established by a judgment, or if execution against his property has been levied without result; (3) if the drawer of a bill not requiring acceptance becomes bankrupt.
