ผู้ทรงเช็คต้องยื่นเช็คแก่ธนาคารเพื่อให้ใช้เงิน คือว่าถ้าเป็นเช็คให้ใช้เงินในเมืองเดียวกันกับที่ออกเช็คต้องยื่นภายในเดือนหนึ่งนับแต่วันออกเช็คนั้น ถ้าเป็นเช็คให้ใช้เงินที่อื่นต้องยื่นภายในสามเดือน ถ้ามิฉะนั้นท่านว่าผู้ทรงสิ้นสิทธิที่จะไล่เบี้ยเอาแก่ผู้สลักหลังทั้งปวง ทั้งเสียสิทธิอันมีต่อผู้สั่งจ่ายด้วยเพียงเท่าที่จะเกิดความเสียหายอย่างหนึ่งอย่างใดแก่ผู้สั่งจ่ายเพราะการที่ละเลยเสียไม่ยื่นเช็คนั้นอนึ่ง ผู้ทรงเช็คซึ่งผู้สั่งจ่ายหลุดพ้นจากความรับผิดไปแล้วนั้น ท่านให้รับช่วงสิทธิของผู้สั่งจ่ายคนนั้นอันมีต่อธนาคาร

English translation

The holder of a cheque must present it to the bank for payment. Where the cheque is payable in the same town in which it was issued, it must be presented within one month from the date of issue; where it is payable elsewhere, within three months. Otherwise the holder loses his right of recourse against all the endorsers, and loses his rights against the drawer to the extent that the drawer suffers loss by reason of the failure to present. A holder whose rights against the drawer have thus been lost is subrogated to the drawer's rights against the bank.
