ผู้รับอาวัลย่อมต้องผูกพันเป็นอย่างเดียวกันกับบุคคลซึ่งตนประกันแม้ถึงว่าความรับผิดใช้เงินอันผู้รับอาวัลได้ประกันอยู่นั้น จะตกเป็นใช้ไม่ได้ด้วยเหตุใด ๆ นอกจากเพราะทำผิดแบบระเบียบ ท่านว่าข้อที่สัญญารับอาวัลนั้นก็ยังคงสมบูรณ์เมื่อผู้รับอาวัลได้ใช้เงินไปตามตั๋วแลกเงินแล้ว ย่อมได้สิทธิในอันจะไล่เบี้ยเอาแก่บุคคลซึ่งตนได้ประกันไว้ กับทั้งบุคคลทั้งหลายผู้รับผิดแทนตัวผู้นั้นส่วนที่ ๔การใช้เงิน
