การถามปากคำเด็กตามวรรคหนึ่ง
ให้พนักงานสอบสวนจัดให้มีการบันทึกภาพและเสียงการถามปากคำดังกล่าวซึ่งสามารถนำออกถ่ายทอดได้อย่างต่อเนื่องไว้เป็นพยาน
ในกรณีจำเป็นเร่งด่วนอย่างยิ่งซึ่งมีเหตุอันควรไม่อาจรอนักจิตวิทยาหรือนักสังคมสงเคราะห์
บุคคลที่เด็กร้องขอ และพนักงานอัยการเข้าร่วมในการถามปากคำพร้อมกันได้

English translation
In cases of offenses relating to sexuality, offenses against life and body that are not offenses arising from an affray, offenses against liberty, offenses of extortion, robbery, and gang robbery under the Penal Code, offenses under the law on prevention and suppression of prostitution, offenses under the law on measures for prevention and suppression of trafficking in women and children, offenses under the law on entertainment venues, or other offenses carrying a penalty of imprisonment where the injured person or a witness who is a child not exceeding eighteen years of age so requests, the questioning of an injured person or a witness who is a child not exceeding eighteen years of age shall be conducted by the inquiry official separately in a place suitable for children, and a psychologist or social worker, a person requested by the child, and a public prosecutor shall be present during the questioning of the child. Where the psychologist or social worker is of the opinion that questioning a child, or a particular question, may have a severe impact on the child's mind, the inquiry official shall put the question specifically through the psychologist or social worker according to the inquiry official's line of questioning, without the child hearing the inquiry official's question, and it is prohibited to question the child repeatedly without reasonable cause. It shall be the duty of the inquiry official to inform the psychologist or social worker, the person requested by the child, and the public prosecutor, and also to inform the injured person or the child witness of the right under paragraph one. A psychologist or social worker, or a public prosecutor, who takes part in the questioning may be objected to by the injured person or the witness who is a child, and if such a case arises, that person shall be replaced. Subject to Section 139, the questioning of a child under paragraph one shall be arranged by the inquiry official so that an image-and-sound recording of the questioning that can be reproduced continuously is made and kept as evidence. In a case of extreme urgency where there is reasonable cause and it is not possible to wait for the psychologist or social worker, the person requested by the child, and the public prosecutor to take part in the questioning together, the inquiry official may question the child with any one of the persons under paragraph one present, but must record the reason it was not possible to wait for the others in the investigation file, and questioning of the injured person or the child witness so conducted shall not be regarded as unlawful.

Sitting in Chapter 1 (Ordinary Inquiry), this section is the child-protective regime for taking statements from victims and witnesses under eighteen. It lists the qualifying offense categories (sexual offenses, violent offenses not arising from an affray, liberty offenses, extortion, robbery and gang robbery, prostitution, trafficking in women and children, and entertainment-venue offenses) and extends to any other imprisonable offense when the child requests it. Core safeguards are a child-suitable setting, the mandatory presence of a psychologist or social worker, a person the child requests, and a public prosecutor, the filtering of severe questions through the psychologist or social worker, a ban on needless repeat questioning, a right to object to and replace a participant, and a mandatory continuous image-and-sound recording kept as evidence. The urgency exception permits questioning with only one required person present, provided the reason is recorded. It is applied to child accused persons by Section 134/2 and works alongside the identification rules in Section 133/3, and its recording is treated as part of court testimony under Section 172/3.

Supreme Court Judgment No. 4217/2565 (2022)
Under Section 133 ทวิ, when the psychologist or social worker considers a question may severely affect the child, the inquiry official must put it specifically through the psychologist or social worker, and questioning conducted through the social worker in that way is lawful.
In a sexual offense against a child victim under eighteen, the Court held that where a question may severely affect the child, Section 133 ทวิ requires it to be put through the psychologist or social worker, so the inquiry official's questioning of the co-plaintiff through the social worker was lawful.

Supreme Court Judgment No. 1903/2565 (2022)
Where the inquiry official records the child victim's statement under Section 133 ทวิ paragraph four and the court plays that recording, the image-and-sound record is treated as part of the victim's testimony under Section 172/3 paragraph three.
Even though the victim did not repeat every fact when testifying, the Court held that because the trial court played the image-and-sound recording made under Section 133 ทวิ paragraph four, that recording formed part of the victim's testimony under Section 172/3, so the recorded facts counted as given in court.

Compliance with the Section 133 ทวิ format does not by itself guarantee the reliability of a child's statement; where the support person also acted as interpreter and there were allegations of coercion, doubt may still attach to the statement.
Although the child victims were questioned in the presence of a psychologist or social worker, a requested person, and a prosecutor under Section 133 ทวิ, the requested support person had also signed as interpreter and a victim alleged threats. The Court found this raised doubt about the reliability of the statements and pre-trial testimony.
