Section 172 bis — Trial and Evidence in the Defendant's Absence

ภายหลังที่ศาลได้ดำเนินการตามมาตรา ๑๗๒ วรรค ๒ แล้ว เมื่อศาลเห็นเป็นการสมควร เพื่อให้การดำเนินการพิจารณาเป็นไปโดยไม่ชักช้า ศาลมีอำนาจพิจารณาและสืบพยานลับหลังจำเลยได้ในกรณีดังต่อไปนี้
(๑) ในคดีมีอัตราโทษจำคุกอย่างสูงไม่เกินสิบปี จะมีโทษปรับด้วยหรือไม่ก็ตาม หรือในคดีมีโทษปรับสถานเดียว เมื่อจำเลยมีทนายและจำเลยได้รับอนุญาตจากศาลที่จะไม่มาฟังการพิจารณาและการสืบพยาน
(๒) ในคดีที่มีจำเลยหลายคน ถ้าศาลพอใจตามคำแถลงของโจทก์ว่าการพิจารณาและการสืบพยานตามที่โจทก์ขอให้กระทำไม่เกี่ยวแก่จำเลยคนใด ศาลจะพิจารณาและสืบพยานลับหลังจำเลยคนนั้นก็ได้
(๓) ในคดีที่มีจำเลยหลายคน ถ้าศาลเห็นสมควรจะพิจารณาและสืบพยานจำเลยคนหนึ่ง ๆ ลับหลังจำเลยคนอื่นก็ได้
(๔) จำเลยไม่อาจมาฟังการพิจารณาและสืบพยานได้เนื่องจากความเจ็บป่วยหรือมีเหตุจำเป็นอย่างอื่นอันมิอาจก้าวล่วงได้
เมื่อจำเลยมีทนายความและจำเลยได้รับอนุญาตจากศาลที่จะไม่มาฟังการพิจารณาและสืบพยาน
(๕) ในระหว่างการพิจารณาและสืบพยาน ศาลมีคำสั่งให้จำเลยออกจากห้องพิจารณาเพราะเหตุขัดขวางการพิจารณา หรือจำเลยออกจากห้องพิจารณาโดยไม่ได้รับอนุญาตจากศาลในคดีที่ศาลพิจารณาและสืบพยานตาม
(๒) หรือ
(๓) ลับหลังจำเลยคนใด ไม่ว่ากรณีจะเป็นประการใด ห้ามมิให้ศาลรับฟังการพิจารณา และการสืบพยาน ที่กระทำลับหลังนั้นเป็นผลเสียหายแก่จำเลยคนนั้นมาตรา

๑๗๒ วรรคสอง แล้ว เมื่อศาลเห็นว่าจำเลยหลบหนีหรือไม่มาฟังการพิจารณาและสืบพยานโดยไม่มีเหตุอันสมควร
ให้ศาลออกหมายจับจำเลย หากไม่ได้ตัวจำเลยมาภายในสามเดือนนับแต่วันออกหมายจับ เมื่อศาลเห็นเป็นการสมควรเพื่อประโยชน์แห่งความยุติธรรมที่จะให้การพิจารณาเป็นไปโดยไม่ชักช้า
และจำเลยมีทนายความ ให้ศาลมีอำนาจพิจารณาและสืบพยานลับหลังจำเลยได้ และเมื่อศาลพิจารณาคดีเสร็จแล้ว
ให้ศาลมีคำพิพากษาในคดีนั้นต่อไปการพิจารณาและสืบพยานตามวรรคหนึ่งต้องมิใช่คดีที่มีอัตราโทษประหารชีวิต หรือคดีที่จำเลยมีอายุไม่เกินสิบแปดปีในวันที่ถูกฟ้องต่อศาลมาตรา

English translation

After the court has proceeded under Section 172 paragraph two, when the court considers it appropriate in order to avoid delay in the proceedings, the court has power to try the case and take evidence in the defendant's absence in the following cases: (1) in a case with a maximum penalty of imprisonment not exceeding ten years, whether or not with a fine, or a case with a fine only, where the defendant has counsel and has been permitted by the court not to attend the trial and the taking of evidence; (2) in a case with several defendants, if the court is satisfied by the prosecutor's statement that the trial and taking of evidence the prosecutor requests do not concern a particular defendant, the court may try the case and take evidence in that defendant's absence; (3) in a case with several defendants, if the court considers it appropriate, it may try and take the evidence of one defendant in the absence of the other defendants; (4) the defendant is unable to attend the trial and the taking of evidence due to illness or another unavoidable necessity, where the defendant has counsel and has been permitted by the court not to attend the trial and the taking of evidence; (5) during the trial and the taking of evidence, the court orders the defendant to leave the courtroom for obstructing the proceedings, or the defendant leaves the courtroom without the court's permission. In a case tried and heard under (2) or (3) in the absence of a defendant, in any event the court shall not admit the trial and the taking of evidence conducted in absence to the prejudice of that defendant. Section 172 bis/1: After the court has proceeded under Section 172 paragraph two, when the court considers that the defendant has absconded or fails to attend the trial and the taking of evidence without reasonable cause, the court shall issue an arrest warrant for the defendant. If the defendant is not obtained within three months from the date the warrant is issued, when the court considers it appropriate in the interest of justice so that the trial may proceed without delay, and the defendant has counsel, the court has power to try and take evidence in the defendant's absence, and when it has completed the trial, the court shall render judgment in the case. The trial and taking of evidence under paragraph one must not be a case carrying the penalty of death or a case where the defendant is not over eighteen years of age on the day the charge is filed with the court. Section 172 bis/2: In a case where the defendant is a juristic person, after the court has proceeded under Section 172 paragraph two, where the court has issued an arrest warrant for the manager or representative of that juristic person but that person has not been obtained within three months from the date the warrant is issued, and no other representative of the juristic person can act on its behalf, when the court considers it appropriate in the interest of justice so that the trial may proceed without delay, the court has power to try and take evidence in the defendant's absence, and when it has completed the trial, the court shall render judgment in the case.

Sitting in the Title on the trial, this section is the principal exception to the Section 172 rule that proceedings must be open in the defendant's presence. It may operate only after the paragraph-two arraignment has taken place, and it lists closed categories, chiefly lesser-penalty cases with a represented and excused defendant, situations affecting only some co-defendants, and removal for courtroom obstruction, with an express bar on admitting in-absence evidence to a defendant's prejudice under (2) and (3). The appended provisions, Section 172 bis/1 and 172 bis/2, added by amendment, let the court proceed in absence where an absconding individual or a company's representative is not secured within three months, subject to the defendant having counsel and to the exclusion of capital and under-eighteen cases. Courts have stressed that if the court has already found the defendant to have fled and issued an arrest warrant, it cannot then treat the defendant as merely absent and continue behind the defendant's back outside these rules.

Why this matters in practice

A represented defendant in a lesser case can often be excused from attending, which saves time, but the excuse must come from the court and the safeguards must be met. Defendants should be aware that disrupting proceedings or walking out can lead to the trial continuing without them, and that absconding triggers an arrest warrant and, after three months, a possible trial in absentia if they have counsel. These protections do not apply in death-penalty or juvenile cases. Supreme Court decisions interpreting this section

  1. Supreme Court Judgment No. 15147/2551 (2008)

    The trial and taking of evidence must be open in the defendant's presence under Section 172 paragraph one, and only when the court considers it appropriate may it excuse the defendant and proceed in absence within the categories of Section 172 bis, such as a case with maximum imprisonment not exceeding ten years where the defendant has counsel and is permitted not to attend.

    The Supreme Court explained that examination of evidence, whether prosecution or defense evidence, must be conducted openly before the defendant under Section 172 paragraph one, and that Section 172 bis lets the court proceed in the defendant's absence only in its listed situations, quoting category (1) on cases with maximum imprisonment not exceeding ten years.

  2. Supreme Court Judgment No. 7561/2542 (1999)

    Once the trial court has found the defendant to have absconded and has issued an arrest warrant, it can no longer conduct any proceeding in the defendant's absence, so treating the defendant as having no further witnesses and closing the case is improper.

    The defendant failed to appear on the date set for defense evidence without explaining the obstacle, and the trial court found the defendant had absconded and issued an arrest warrant. The Supreme Court held that after such a finding the court could not carry on the proceeding behind the defendant's back by deeming the defense case closed and setting a judgment date.

  3. Supreme Court Judgment No. 35/2536 (1993)

    Under Section 172, the trial and taking of evidence must be conducted openly in the defendant's presence unless otherwise provided, as in the situations under Section 172 bis, so evidence given at the preliminary-hearing stage is not treated as trial testimony.

    The Supreme Court held that under Section 172 the trial and evidence must be open before the defendant except as otherwise provided, for example under Section 172 bis. Because certain testimony and a document were given and submitted only at the preliminary-hearing stage, not at trial, the appeal court properly declined to rely on them.
