An acknowledged child can attack a bigamous marriage: Dika 2984/2569

In Dika 2984/2569 the Supreme Court held that a child acknowledged by her father has standing, as his statutory heir under CCC sections 1627 and 1629, to sue for annulment of the father’s later marriage — registered while an earlier marriage was still in place, contrary to section 1452. A void “surviving spouse” would otherwise cut into the child’s inheritance share.
