SUMMARY
The deceased, an army corporal, held the roster duty of orderly but was watching television in a rest tent when the defendant and his companions attacked and killed him; a stray round also killed one of the defendant's own party. The trial court convicted under Section 288 read with Sections 60 and 83 and imposed life imprisonment. The Court of Appeal added Section 289, punished under it as the heavier provision, and imposed death, so the further appeal was against a death sentence. The Supreme Court read Section 289(2) as requiring that the official be engaged in some act of duty at the moment he is killed, held that holding the post while resting was not enough, and varied the judgment so that the trial court's judgment is the one enforced.
FACTS OF THE CASE
The defendant killed a government official who was off-duty and watching television at home. The prosecution charged under Section 289(2), which provides an enhanced penalty for killing a government official performing duties.
COURT'S HOLDING
The Supreme Court held that for Section 289(2) to apply, the official must be actively performing official duties at the time of the killing. An off-duty official is protected only under Section 288 (simple murder), not Section 289(2).
LEGAL ANALYSIS
The provision protects the performance of duty, not the person who holds the office, and the distinction decides the case. The deceased was a duty NCO, so he was on duty in the roster sense, but at the moment he was attacked he was watching television in a rest tent and was performing no act of duty at all.
The Court added that the attack arose from a private quarrel between the deceased and members of the defendant's group, which reinforces the same point: where the motive has nothing to do with the office, the aggravation in Section 289(2) has nothing to attach to.
PRACTICAL IMPLICATIONS
Whether the victim held office matters less than what the victim was doing. Section 289(2) raises the penalty only where the official was actually carrying out a duty at the moment of the killing, so an officer who is off duty or resting falls under Section 288 alone. The point to establish is the victim's activity at that moment, not the victim's rank or posting.

Frequently Asked Questions คำถามที่พบบ่อย
When does killing a government official carry the enhanced penalty under Section 289(2)? การฆ่าเจ้าพนักงานจะเป็นความผิดตามมาตรา 289(2) เมื่อใด
Only where the official is actually carrying out a duty at the moment of the killing. In Decision 3090/2527 the deceased was a duty NCO who was watching television in a rest tent when the defendants came in, attacked him and killed him. The Supreme Court held he was not then performing any duty, so this was not the killing of an official acting in the execution of his duty and Section 289(2) did not apply.
