สิทธิเหนือพื้นดินนั้นจะก่อให้เกิดโดยมีกำหนดเวลา หรือตลอดชีวิตเจ้าของที่ดิน หรือตลอดชีวิตผู้ทรงสิทธิเหนือพื้นดินนั้นก็ได้ถ้าก่อให้เกิดสิทธิเหนือพื้นดินโดยมีกำหนดเวลาไซร้ ท่านให้นำบทบัญญัติ
