Section 1437 — Khongman and sinsod

การหมั้นจะสมบูรณ์เมื่อฝ่ายผู้หมั้นได้ส่งมอบหรือโอนทรัพย์สินอันเป็นของหมั้นให้แก่ผู้รับหมั้นเพื่อเป็นหลักฐานว่าจะสมรสกับผู้รับหมั้นนั้น
เมื่อหมั้นแล้ว ให้ของหมั้นตกเป็นสิทธิแก่ผู้รับหมั้น
สินสอดเป็นทรัพย์สินซึ่งฝ่ายผู้หมั้นให้แก่บิดามารดา ผู้รับบุตรบุญธรรม หรือผู้ปกครองฝ่ายผู้รับหมั้น แล้วแต่กรณี เพื่อตอบแทนการที่ผู้รับหมั้นยอมสมรส ถ้าไม่มีการสมรสโดยมีเหตุสำคัญอันเกิดแก่ผู้รับหมั้น หรือโดยมีพฤติการณ์ซึ่งฝ่ายผู้รับหมั้นต้องรับผิดชอบ ทำให้ผู้หมั้นไม่สมควรหรือไม่อาจสมรสกับผู้รับหมั้นนั้น ฝ่ายผู้หมั้นเรียกสินสอดคืนได้
ถ้าจะต้องคืนของหมั้นหรือสินสอดตามหมวดนี้ ให้นำบทบัญญัติมาตรา ๔๑๒ ถึงมาตรา ๔๑๘ แห่งประมวลกฎหมายนี้ ว่าด้วยลาภมิควรได้ มาใช้บังคับโดยอนุโลม

English translation
A betrothal becomes complete when the betrothing party delivers or transfers property, being the khongman, to the betrothed party as evidence that the betrothing party will marry that betrothed party.
Once the betrothal has been made, the khongman becomes the property of the betrothed party.
Sinsod is property given by the betrothing party to the parents, the adoptive parent or the guardian of the betrothed party, as the case may be, in return for the betrothed party agreeing to marry. If there is no marriage by reason of a material fact attributable to the betrothed party, or by reason of circumstances for which the betrothed party is responsible, making it improper or impossible for the betrothing party to marry that betrothed party, the betrothing party may claim the sinsod back.
Where the khongman or the sinsod has to be returned under this Chapter, Sections 412 to 418 of this Code, on undue enrichment, apply mutatis mutandis.
