ถ้าสัญญาว่าจะทำการชำระหนี้อย่างอื่นให้เป็นเบี้ยปรับ ไม่ใช่ใช้เป็นจำนวนเงินไซร้ ท่านให้นำบทบัญญัติแห่งมาตรา ๓๗๙ ถึง ๓๘๑ มาใช้บังคับ แต่ถ้าเจ้าหนี้เรียกเอาเบี้ยปรับแล้ว สิทธิเรียกร้องค่าสินไหมทดแทนก็เป็นอันขาดไป

English translation
If another performance than the payment of a sum of money is promised as penalty, the provisions of Sections 379 to 381 apply; the claim for compensation is barred if the creditor demands the penalty.
