ในการขายฝาก คู่สัญญาจะตกลงกันไม่ให้ผู้ซื้อจำหน่ายทรัพย์สินซึ่งขายฝากก็ได้ ถ้าและผู้ซื้อจำหน่ายทรัพย์สินนั้นฝ่าฝืนสัญญาไซร้ ก็ต้องรับผิดต่อผู้ขายในความเสียหายใด ๆ อันเกิดแต่การนั้น

English translation
The parties may agree that the buyer shall not dispose of the property sold. If he disposes of it contrary to his agreement, he shall be liable to the seller for any injury resulting thereby.
