อันว่าให้นั้น คือสัญญาซึ่งบุคคลคนหนึ่งเรียกว่าผู้ให้ โอนทรัพย์สินของตนให้โดยเสน่หาแก่บุคคลอีกคนหนึ่ง เรียกว่าผู้รับ และผู้รับยอมรับเอาทรัพย์สินนั้น
