ตัวการซึ่งมิได้เปิดเผยชื่อจะกลับแสดงตนให้ปรากฏและเข้ารับเอาสัญญาใด ๆ ซึ่งตัวแทนได้ทำไว้แทนตนก็ได้ แต่ถ้าตัวการผู้ใดได้ยอมให้ตัวแทนของตนทำการออกหน้าเป็นตัวการไซร้ ท่านว่าตัวการผู้นั้นหาอาจจะทำให้เสื่อมเสียถึงสิทธิของบุคคลภายนอกอันเขามีต่อตัวแทน และเขาขวนขวายได้มาแต่ก่อนที่รู้ว่าเป็นตัวแทนนั้นได้ไม่

English translation

An undisclosed principal may declare himself and assume any contract entered into on his behalf. But the principal who allows his agent to act as a principal cannot prejudice the rights of the third person against the agent acquired before notice of agency.
