The agent must act according to the express or implied directions of the principal. In the absence of such directions, he must pursue the accustomed course of business in which he is employed. The provisions of Section 659 concerning Deposit apply mutatis mutandis .

Section 807 places the burden of strict compliance on the agent. The agent who exceeds instructions is personally liable for damages (§812). However, the agent has a duty to act in emergencies even without authorization where waiting would harm the principal — a doctrine drawn from §815. SC decisions consistently distinguish between "taking initiative for principal's benefit" (protected) and "acting on personal judgment about what's best" (not protected).
