ถ้าวัตถุอันได้เอาประกันภัยไว้นั้น เปลี่ยนมือไปจากผู้เอาประกันภัยโดยพินัยกรรมก็ดี หรือโดยบัญญัติกฎหมายก็ดี ท่านว่าสิทธิอันมีอยู่ในสัญญาประกันภัยก็ย่อมโอนตามไปด้วยถ้าในสัญญามิได้กำหนดไว้เป็นอย่างอื่น เมื่อผู้เอาประกันภัยโอนวัตถุที่เอาประกันภัยและบอกกล่าวการโอนไปยังผู้รับประกันภัยไซร้ ท่านว่าสิทธิอันมีอยู่ในสัญญาประกันภัยนั้นย่อมโอนตามไปด้วย อนึ่ง ถ้าในการโอนเช่นนี้ช่องแห่งภัยเปลี่ยนแปลงไปหรือเพิ่มขึ้นหนักไซร้ ท่านว่าสัญญาประกันภัยนั้นกลายเป็นโมฆะ

English translation
Where the subject matter insured passes from the insured by will or by operation of law, the rights under the contract of insurance pass with it.
Where the insured transfers the subject matter insured and gives notice of the transfer to the insurer, the rights under the contract of insurance pass with it, unless the contract provides otherwise.
If, on such a transfer, the risk is changed or substantially increased, the contract of insurance becomes void.
