ถ้าความวินาศเกิดขึ้นเพราะภัยมีขึ้นดังผู้รับประกันภัยตกลงประกันภัยไว้ไซร้ เมื่อผู้เอาประกันภัยหรือผู้รับประโยชน์ทราบความวินาศนั้นแล้ว ต้องบอกกล่าวแก่ผู้รับประกันภัยโดยไม่ชักช้าถ้ามิได้ปฏิบัติตามบทบัญญัติที่กล่าวมาในวรรคก่อน ผู้รับประกันภัยอาจเรียกร้องค่าสินไหมทดแทนเพื่อความเสียหายอย่างใด ๆ อันเกิดแต่การนั้นได้ เว้นแต่อีกฝ่ายหนึ่งจะพิสูจน์ได้ว่าไม่สามารถที่จะปฏิบัติได้
