แม้ในกรณีที่ผู้เอาประกันภัยมิได้เป็นผู้รับประโยชน์เองก็ดี ผู้เอาประกันภัยย่อมมีสิทธิที่จะโอนประโยชน์แห่งสัญญานั้นให้แก่บุคคลอีกคนหนึ่งได้ เว้นแต่จะได้ส่งมอบกรมธรรม์ประกันภัยให้แก่ผู้รับประโยชน์ไปแล้ว และผู้รับประโยชน์ได้บอกกล่าวเป็นหนังสือไปยังผู้รับประกันภัยแล้วว่าตนจำนงจะถือเอาประโยชน์แห่งสัญญานั้น ถ้ากรมธรรม์ประกันภัยได้ทำเป็นรูปให้ใช้เงินตามเขาสั่งแล้ว ท่านให้นำบทบัญญัติมาตรา ๓๐๙ มาใช้บังคับ

English translation

Even where the insured is not himself the beneficiary, the insured is entitled to transfer the benefit of the contract to another person, unless the policy has already been delivered to the beneficiary and the beneficiary has notified the insurer in writing of his intention to take the benefit of the contract.

Where the policy is made payable to order, Section 309 applies.
